Section 31.2.4.1 of the Albemarle County Zoning Ordinance states that, "The board of supervisors hereby
reserves unto itself the right to issue all special use permits permitted hereunder. Special use permits for
uses as provided in this ordinance may be issued upon a finding by the board of supervisors that such use
will not be of substantial detriment to adjacent property, that the character of the district will not be
changed thereby and that such use will be in harmony with the purpose and intent of this ordinance, with
the uses permitted by right in the district, with additional regulations provided in section 5.0 of this
ordinance, and with the public health, safety and general welfare."

How will the proposed special use affect adjacent property?
The sign currently located on this property was put in place 20 years ago with no specific business
park tenants listed. Over the years, tenants have added magnetic logos to the sign, causing the sign to
look messy and unappealing. The new sign will include updateable spaces for tenants keeping the
look consistent, cohesive and more professional, thus positively affecting the adjacent property.
How will the proposed special use affect the character of the district(s) surrounding the property?
The surrounding properties are predominately Planned Unit Developments, just as the sign display
property and the Mill Creek Business Park. The proposed special -use will not affect the character of the
district. The sign will be consistent with the look of other signs in the area.
How is the use in harmony with the purpose and intent of the Zoning Ordinance?
The sign will identify a PUD -zoned business park which cannot be seen from the main road. The new
sign will be erected on the existing brick pier, which matches the surrounding buildings' primary
material and will be within the maximum size limits for PUD zoning. The current landscaping is over-
grown, so it will be trimmed back slightly, but still allows the sign to blend in with the surroundings.
How is the use in harmony with the uses permitted by right in the district?
The sign will publicize a business park which includes administrative /professional offices, such as
South Side Dental Center and Charlottesville Family Medicine, as well as health spas (e.g., Pura Vida
Salon) and day care centers (e.g, Bright Beginnings Preschool).

Additional regulations of Section 5.0 do not apply to this special use.
How will this use promote the public health, safety, and general welfare of the community?
- The addition of specific tenants to the Mill Creek Business Park sign will allow clients and patients of -
listed businesses to have quicker and easier access to the business park with less confusion while
driving down Avon Road Extended.
Describe your request in detail and include all pertinent information such as the number of persons involved in
the use, operating hours, and any unique features of the use:
We would like to replace an existing sign on this property with a new sign which includes
business tenants not specifically located on the same parcel of land. The new sign will be the same size
of the existing sign. It will be 18 2/3 square feet, which is 5 1/3' less than the maximum area allowed
monument signs on PUDs (24 sq. ft.). The design is simple with clean lines and muted natural colors.
The two main colors mimic those found on a few of the buildings in the business park.
We would like the ability to update the list of tenants and add names, as new tenants move in.
The tenant list can be easily updated, by use of black cast vinyl applique, which will keep the sign
professional and consistent.
The existing brick pier we will be using, matches the building located on the same parcel of
land, as well most of the buildings that are visible near the sign. The pier is 58 "W x 32 "H x 17 "D. The
sign's maximum height atop the pier will be 8 2/3: The foundation is located out of the VDOT right -of-
way and is set back further than 5, which is the minimum setback for PUDs.
