RE: Request dated February 18, 2010 and received February 19, 2010 for variations
from the application plan and code of development for ZMA 200500005 which has
been made in conjunction with SDP 200900102 Liberty Hall;
this letter incorporates variations previously approved in the letter of February 23,
2010 from Wayne Cilimberg, Director of Planning, to Frank Pohl, Timmons Group.
Dear Mr. Silman :
The County has received the request referenced above for variations to:
• Block 1 to create 20 townhouse units along Colony Drive (labeled Road B on the
Application Plan) and Pioneer Lane (labeled Road B on the Application Plan)
where 22 townhouse /condo units were shown on the application plan.
Locate affordable townhouse units (Units 32 -40) south of Pioneer Lane in Block 1.
This is a variation from the location and unit type shown on the approved
application plan which proposed condo units (Units 1,2,10,11,12,13, 21 and 22) at
the ends of the two rows of townhouses. (ZMA 200700014, which amended only
the proffers for this development, allows substitution of townhouses for the
affordable condo units.)
• Block 4 to create six (6) townhouse units where five (5) were originally shown on
the application plan and create lots for units 4 -7 with 20' lot frontages. This
requires a variation to the code of development and application plan, which have
a minimum lot frontage requirement of 25'. (Refer to Table 2 - Lot and Yard
Requirements, Page 12 of Code of Development)
• Approved landscape and amenities shown on the application plan in Blocks 2, 4
and 6 as described in your letter dated January 29, 2010.
This letter serves to provide APPROVAL to these variations in keeping with the
depictions on SDP 200900102, based on the analysis that follows.
Section 8.5.5.3 authorizes the director of planning to grant variation(s) from an approved
application plan and code of development for "minor changes to yard requirements, ... ",
"changes to the arrangement of buildings and uses shown on the plan, ..." and "minor
changes to landscape ... standards" upon a determination that the variation(s) is:
1) consistent with the goals and objectives of the comprehensive plan.
The variations do not conflict with the goals and objectives of the comprehensive plan as
the principles of the Neighborhood Model are being retained.
2) does not increase the approved development density or intensity of
development.
The variations will not increase the overall approved density or intensity of the
development as the number of dwelling units would be reduced by one (1). This variation
allows an additional townhouse unit in Block 4, but does not increase the overall building
footprints in that block since smaller unit sizes are proposed than shown on the
application plan.
3) does not adversely affect the timing and phasing of development of any
other development in the zoning district.
The variations do not affect timing or phasing of any other development.
4) does not require a special use permit.
The variations do not require a special use permit.
5) is in general accord with the purpose and intent of the approved rezoning
application.
The variations are for minor changes to the number of dwelling units, lot frontage
requirements, location of affordable units, and landscaping /amenities within blocks of the
approved application plan; the important design features of each block are still being
maintained.
