Dear Ms. Woltz:
At their meeting on April 6, 2010, the Board of Zoning Appeals voted 5-0 to approve the
request for relief from Section 18-4.1.3 to reduce the area requirements for a dwelling
and proposed commercial establishment (2 uses) on private well and septic, from
120,000 square feet to 17,652 square feet. This variance may allow an antique shop as
a secondary use within the dwelling, subject to the following conditions:
1. No public bathrooms may be provided for the commercial use;
2. The commercial use is limited to a maximum of 680 square feet within the
existing structure;
If you are aggrieved by this decision, you have the right to appeal it within thirty (30)
days of the date of the decision, in accordance with Section 15.2-2314 of the Code of
Virginia. If you do not file a timely appeal, this decision shall be final and unappealable.
An appeal shall be taken only by filing a petition specifying the grounds on which
aggrieved with the Circuit Court of Albemarle County within the prescribed thirty (30)
days.
