April 19, 2010 County of Albemarle Department of Planning and Community Development 401 McIntire Road Charlottesville, VA 22902 RE: Morey Creek Professional Center - Request for Critical Slopes Waiver TMP 76 -12A & 12G To whom this may concern: Please consider this critical slopes waiver request to allow minimal impacts to critical slopes located within the property of the proposed Morey Creek Professional Center. The following are the critical slope calculations for the site (refer to attached exhibit): Total site area 12.606 acres Total area of critical slopes on site 1.77 acres (14.0% of total site area) Total area of critical slopes impacted 0.59 acre (33.3% of total critical slopes on -site; 4.7% of total site area) The minimal impacts proposed are necessary to proposed office and day care facility on this topographically challenged and very constrained site. The following explanation addresses the five issues described in Section 4.2 of the Albemarle County Code regarding potential effects of impacting critical slopes. 1. Rapid and /or Large -Scale Movement of Soil and Rock: Of the total 72.606 acres within parcel only 0.59 acres of critical slope impacts are proposed, corresponding to under 5 o of the total project area. Z. Excessive Stormwater Runoff: Stormwater drainage facilities will be implemented throughout the site to control runoff in a manner meeting the minimum State standards. Conservation and preservation areas have been designated along the existing creek /pond to protect the integrity of this resource. Slopes proposed to be impacted are central to the site and are not contiguous to water bodies or streams. This will allow for the implementation of sediment control measures between areas of critical slope impacts and such features. Critical slopes adjacent these features are not proposed to be impacted. 3. Siltation of Natural /Man -Made Bodies of Water: E &S Control Measures will be implemented between the proposed critical slopes to be impacted and the natural /man -made on -site pond. This will ensure that any soils coming from the grading activities will be intercepted before reaching the pond. Critical slopes central to the site are proposed to be impacted and those slopes adjacent the wetlands /pond will remain undisturbed. Once construction is complete, the site will be stabilized to prevent erosion. 4. Loss of aesthetic resource: The scenic creek which tra verses the site will be protected and maintained to preserve this aesthetic resource. The critical slopes to be impacted are currently not visible from off the site considering the site is somewhat wooded. There is also a stockpile on the site that was imported from the previous developer, which has already impacted these slopes. The proposed plan includes trees along the perimeter of the development to maintain the wooded nature of the site as much as possible. 5. In the event of septic system failure a greater travel distance of septic effluent: April 16, 2010 Page 3 of 3 The proposed project will be served by a public gravity sewer system; therefore, septic system failures are not a concern. if existing septic systems are discovered during the construction of the proposed buildings or parking garage, the septic systems will be abandoned in place or removed in accordance with State and County standards. Based on the calculations and explanation provided above, the minimal critical slope impacts requested will not constitute potential dangers to the public health, safety and /or welfare.
