No residential units proposed. ZONING CATEGORY /GENERAL USAGE: C -1 Commercial - retail sales and service uses; and residential use by speciai use permit (15 units/ acre) and primarily HC Highway Commercial - commercial and service uses; and residential use by special use permit (15 units/ acre) SECTION: Sections 22.2.2.5 and 24.2.2.4 of the Zoning Ordinance which allows for veterinary office and hospital uses. COMPREHENSIVE PLAN LAND USE /DENSITY: Community Service - community -scale retail wholesale, business and medical offices, mixed use core communities and/or employment services, and residential (5.01 -34 units /acre) in Neighborhood 1. ENTRANCE CORRIDOR: Yes LOCATION: 370 Greenbrier Dr. Approximately 575 feet west of the intersection of Greenbrier Drive and Route 29 (Seminole Trail) TAX MAP /PARCEL: 51W, Section 1, Block A, Parcel 5 MAGISTERIAL DISTRICT: Rio Character of the Area and Adioining properties: The subject property lies at 370 Greenbrier Dr., approximately 675 feet west of the intersection of Greenbrier Drive and Route 29 (Seminole Trail). The property has split zoning of C -1 and HC, commercial. In both districts, veterinary clinics are allowed by special use permit only. Two buildings are located on the property, which include uses that provide building supply and paint. Other uses located on the property include an Internet cafe /store, a laundry mat, Girl Scouts office, roofing company and Jiffy Lube. See Attachment A for the Zoning Map, including the location of the existing veterinary clinic and Attachment B for the Location Map. The surrounding area consists of commercial development. Specifics of Proposal: The applicant is requesting to extend the currently allowed overnight business hours of the existing animal hospital to also include daytime business hours of 9:00 a.m. to 5:00 p.m. Monday to Friday. The animal hospital currently provides an overnight emergency clinic. The applicant wishes to also provide a daytime specialty veterinary clinic that would be unique to the Charlottesville /Albemarle area and increase the options for pet care in the area. In order to be able to provide this service, the applicant proposes to use an additional 2,525 square feet of vacant adjacent warehouse space. (See Attachment C) The possible specialty services could include acupuncture, ophthalmology, neurology or other therapeutic veterinary techniques. Greenbrier Emergency animal Hospital PC Putrhc Hearing 6!22110 Applicant's Justification for the Request: The applicant currently operates the existing emergency animal clinic. The applicant states that specialty services for animals are not located in the Charlottesville /Albemarle area and that residents often travel to the Richmond area for services such as acupuncture, ophthalmology and neurology. Planning and Zoning History: .January 13, 1984 — Planning Commission approved Pargo's Restaurant and Office Condominium site plan. SDP 1983 -045 — Pargo's Restaurant site plan — indefinitely deferred. February 14, 1985 — Planning Commission recommended denial of ZMA 84 -32, which was a rezoning request from C -1 to HC with proffers, stating that scope and possibilities of uses was too broad. February 20, 1985 — Board of Supervisors approved ZMA 84 -32. This action rezoned the property from C -1 to HC with proffers. June 11, 1985 — Planning Commission approved Greenbrier Park site plan. SOP 1985 -030 — Greenbrier Park site plan July 30, 1985 — Planning Commission recommended approval of ZMA 85 -18 which amended the previous rezoning to allow Motels, and approved Super 8 Motel site plan. SDP 1985 -033 — Super 8 Motel site plan August 7, 1985 — Board of Supervisors approved ZMA 85 -18. This added hotels, motels, and inns as an allowed use for a portion of the site (Proffered). March 21, 1990 — Board of Supervisors approved ZMA 90 -01 which added Fast Food Restaurant to the list of allowed uses (Proffered). November 7, 1990 — Board of Supervisors approved ZMA 90 -15 which permitted churches. October 1,'1991 — The Planning Commission recommended approval of ZMA 91 -06, a request to rezone the property to C -1, Commercial (Proffered) and HC, Highway Commercial (Proffered). November 20, 1991 — The Board of Supervisors approved SP 91 -52 a request for an emergency veterinary office. SDP 2003 -003 — Greenbrier Square Minor Comprehensive Plan: The Land Use Plan designates this area as Community Service in Neighborhood One (1). The Comprehensive Plan supports community scale business uses, such as veterinary office /hospital in areas designated Community Service. The site will not be used for residential purposes. Greenbrier Emergency Animal Hospital PC Public Hearing 0122110 An analysis for consistency with the Neighborhood Model was not done for this project since it is an existing development and does not propose re- development. It is an expansion of an existing use at the site. Staff Comment: Section 31.6 of the Zoning Ordinance below requires that special use permits be assessed as follows: Will the use be of substantial detriment to adjacent property? There is no record of impacts to adjacent property from the animal hospital that has operated at this location for a number of years. No detriment to adjoining properties is anticipated from the requested expanded use because all veterinarian activities will continue to be inside the building. Will the character of the zoning district change with this use? The character of the district has not been changed by the existing animal hospital and it is not anticipated that the character will change with the expansion of hours and space of the existing use. Will the use be in harmony with the purpose and intent of the zoning ordinance? The HC zoning district is intended for commercial uses oriented to the highway. Veterinary offices /hospitals are allowed by special use permit in this district_ The veterinary officelhospital is viewed as a use supportive to Albemarle County residents who will predominantly arrive by vehicle. Will the use be in harmony with the uses permitted by right in the district? Section 24.2.1 of the Zoning Ordinance, entitled Highway Commercial, HC, allows a variety of commercial uses by -right as well as those that are permitted by special use permit. Veterinary office and hospital are permitted by special use permit in HC districts. The existing animal hospital has operated in harmony with by -right uses at this location for a number of years. The proposed new hours of business will be by appointment only and will have the same staffing requirements as the current overnight clinic. The existing assigned parking spaces will be adequate for the additional operating hours so traffic and parking associated with this expanded use should not detrimentally affect by -right uses. The proposed expansion of the veterinary officelhospital use continues to be compatible with the other permitted uses in this district. Will the use comply with the additional regulations provided in Section 5.0 of this ordinance? Section 5.1.11 is applicable to the proposed animal hospital use and each regulation is addressed below: a. Except where animals are confined in soundproofed, air - conditioned buildings, no structure or area occupied by animals shall be closer than five hundred (500) feet to any agricultural or residential lot line. For non - soundproofed animal confinements, an external solid fence not less than six (6) feet in height shall be located within fifty (50) feet of the animal confinement and shall be composed of concrete block, brick, or other material approved by the zoning administrator, (Amended 71- 15-89) Animals will be confined to the soundproofed, air- conditioned building. For soundproofed confinements, no such structure shall be located closer than two hundred (200) feet to any agricultural or residential lot line. For soundproofed confinements, noise measured at the nearest agricultural or residential property line shall not exceed fifty -five (55) decibels; (Amended 11- 75 -89; 6- 14-00) There are no residential lot lines located closer than two hundred (200) feet and noise at the nearest residential lot line is not expected to exceed fifty -five (5 5) decibels due to the distance and sound proofed confinement. c, In all cases, animals shall be confined in an enclosed building from 10:00 p.m. to 6:00 a.m. (Amended 11- 15 -89; 6- 14 -00) The applicant has indicated that this requirement will be met and that there will be no outdoor activity for these animals during these hours or any other business hours. d. In areas where such uses may be in proximity to other uses involving intensive activity such as shopping centers or other urban density locations, special attention is required to protect the public health and welfare. To these ends the commission and board may require among other things: (Amended 11- 15 -89) - Separate building entrance and exit to avoid animal conflicts ;( Added 11- 15 -89) -Area for outside exercise to be exclusive from access by the public by fencing or other means. (Added 11- 15-89) The animal hospital currently has its' own separate building entrance and is located in an end unit of the building with over 40 feet in any direction to the next occupied space. This entrance will continue to be used for the expanded adjacent space. There will be no outside exercise area because the specialty service will be by appointment only and the veterinary hospital is an emergency based service that returns animals to their primary care provider by the next business day. Animals will not be kenneled or stay for prolonged service at this facility. Will the public health, safety and general welfare of the community be protected if the use is approved? The public health, safety, and general welfare of the community will be protected through the special use permit conditions that specifically address this use at this location. There is no safety concern with the proposed veterinary services clinic use. Summary: Staff finds the following factors favorable to this request: 1. The special use permit is consistent with the Land Use Plan. 2. The special use permit will provide an opportunity for the expansion of veterinary services in the Development Area. Staff finds no factor(s) unfavorable to this request. Recommended Action: Staff recommends approval of SP 2009 -030, Greenbrier Emergency Animal Hospital with the following revisions to the originally approved conditions. FRITZ PLANNING COMMISSION: OCTOBER 15, 1991 BOARD OF SUPERVISORS: NOVEMBER 20, 1991 SP -91 -52 GREENBRIER LIMITED PARTNERSHIP Petition: Greenbrier Limited Partnership petitions the Board of Supervisors to permit an emergency veterinary office on 3.1 acres currently zoned HC, Highway Commercial [PROFFERED] (ZMA -91 -06 is pending). Property, described as Tax Map 61U, Section 1, Block A, Parcel 5, is located on the north side of Greenbrier Drive approximately 500 feet west of Route 29 in the Charlottesville Magisterial District. This site is located within Neighborhood 1. This site is within the EC, Entrance Corridor Overlay District.. Character of the Area: This property is the location of Greenbrier Square. Adjacent properties are developed commercially. Applicant's Proposal: The applicant is proposing to locate a veterinary office to provide for emergency care of injured or ill animals only. The office would be open evenings and weekends when other vets are unavailable. No routine appointments will be made. A description of the activity is provided as Attachment C. SUMMARY AND RECOMMENDATIONS: staff has reviewed this request for compliance with Section 31.2.4.1 of the Zoning Ordinance and recommends approval of SP- 91 -52. October 1, 1991 - The Planning Commission recommended approval of ZMA-91 -06, a request to rezone the property to C--1, Commercial (Proffered) and HC, Highway Commercial (Proffered). STAFF COMMENT: This activity will occur during evenings and weekends when other uses on site will be at a minimum. All animals will be removed from the site at the beginning of the following week's first business day. Traffic figures for this type of use are unavailable. Staff anticipates that traffic generation would be extremely low. Staff has reviewed this request for compliance with Section 5.1.11 which states in part: "In areas where such uses may be in proximity to other uses involving intensive activity such as shopping centers or other urban density location, special attention is required to protect the public health and welfare. To these ends the commission and board may require among other things: Separate building entrance and exit to avoid animal conflicts; Area for outside exercise to be exclusive from access by the public by fencing or other means. No outside exercise area is proposed as all animals would ill or injured and would be removed from the site the following business day. Staff opinion is that separate entrances are not needed as conflicts are not likely due the low volume of use and that only ill animals would be brought to the site. 2 be PR Other items of Section 5.1.11 will be met by the applicant. This use will not affect any residential areas as the nearest dwelling is approximately 804 feet distant. All requirements relating to the operation of the clinic such as x -rays and disposal of deceased animals are addressed by the approval process of the Board of Veterinary Medicine. During the review of SP -90 -108 (a veterinary clinic in Pantops Shopping Center), staff prepared information to address specific concerns stated by the Board. That information is included as Attachment D. It is the opinion of staff that this use is a low traffic generator which is consistent with past County efforts to limit traffic on this site. The use will provide a service to the general public and will not interfere with adjacent commercial uses. Based on the above comments, staff recommends approval of SP -91 -52 subject to the following conditions: RECOMMENDED CONDITIONS OF APPROVAL: 1. There shall be no outside exercise area; 2. No animals are to be confined outside; 31 Use is limited to 370 Greenbrier Drive. 4. Hours of operation shall be limited to: Monday - Thursday: 5:30 P.M. - 9:00 A.M. 5:30 P.M. Friday until 9:00 A.M. See attached site plan. Square Footage 2700 2. The hours of operation will initially be from 5:30 pm on Fridays until 9:00 an on Mondays. They would like to have the flexibility in the future to operate during non - business hours on a daily basis. 3. only injured and ill animals will be boarded on site. Dr. Betts noted that ill animals do not make as much noise as healthy animals, and that all the animals would be transferred from the emergency clinic to another Veterinarian hospital by 8:00 am of the following business day. 4. The center will only be used for emergency services. It may be helpful to explain to the Planners that this emergency clinic is a consortium of Veterinarian clinics and exists only to provide care during their non business hours. At all other times the individual, clinics have their own economic incentive to provide treatment at their own facilities. 5. The clinic will provide any emergency care as needed. No routine, non emergency care will be offered such as grooming or boarding. S. We, as the landlords, will require everything that is stipulated in SP -90 -08 Riverbend Limited Partnership to be done at Greenbrier Square. 7. Section 5.1.11 has stipulations under item D requirements for outside exercise. Because of the nature of the operation, we had not planned any outdoor exercise area. Frltz, Senor Planner Liv Dt T F: April 12, 1990 RE: SP-90 -08 Rive--bend Limited Partnership The Board of Supervisors reviewed the above referenced ATTACHMENT D permit on March ?_", 1930 and deferred action in order to a'low sta -r" to address concerns raised by the public. Those issues and the means of addressing then are as follows: �'I Type of veterinary hospital or clinic. -- The proposed clinic is a small animal care center. a. Radiation P:otection - The Board of Veterinary Medicine requires approval from the State Department of Health for any x--ray equipment. This requirement is similar to that for dentist and doctor offices. c . Disposal of deceased animals after hours. - "he Board of Veterinary Medicine requires a freezer unit to be used exclusively for the storage of deceased animals awaiting pickup by the SPCA. Other methods of disposal may be approved. d. € Isolation room location. - The Board of Veterinary Medicine requires the provision of an isolation room. r Noise. - Staff review has found no state regulations as to noise. The City of Charlottesville has required "that the building area where animals are housed be enclosed with walls and window construction having a sound transmission class of at least 50." Examination of animals outside of the building. - The Board of Veterinary medicine requires that all examinations take puce in an examination room. Emergency examinations are excluded from this requirement. h. concern was raised about spread of infectious diseases to the adjacent net shop. Staff discussion with the Board of Veterinary Medicine indicated that normal building construction_ and vet practices would riot promote the spread of infectious diseases to any adjacent use. i. Water and sewage requirements_ - The site is served by public water and sewer. The Board of Veterinary Medicine requires adequate provision for water and sewage disposal as well as approval by the Health Department. j. Disposal of tray chemicals, sharp instruments and tissue. - The disposal of tissue is addressed by the Board of Veterinary medicine in a like manner as disposal of deceased animals. The Board of 4reterinary Medicine has no requirements for the disposal of tray chemicals or instruments. An Industrial Waste Survey Form submitted to the Albemarle County Service Authority will determine if any chemicals can be disposed of by the public sewage system. This site is located in a designated growth area. 10 -15 -91 W Mr. Fritz presented the staff report_ Staff recommended approval subject to conditions. There was a brief discussion as to how long animals would remain at the facility and whether or not there would always be an attendant present. Mr. Rittenhouse noted that the staff report made reference to the animals being removed "on the following business day." He wondered if a condition should be added accordingly. (It was later decided that condition No. 6 would be added as follows: "Animals shall be permitted on site only during hours of operation. ") Ms. Huckle asked if convenient parking would be available, i.e. close enough so as to make it easy for persons who would be bringing large injured animals. (The applicant confirmed that a "roll --up door" was available from the rear of the building.) The applicant was represented by Ms. Bruce Murray. She described the proposed emergency veterinary clinic. ❑r. Charles Wood, one of the participating veterinarians, gave the following replies in response to commission questions: --- Special staff members will staff the clinic - -a full -time emergency veterinarian and a technician (plus clean -up workers). Area vets will serve as back -ups in case of emergencies. --- Animals will have to be removed by their owners on the morning following their admittance. If they are left past pick -up time, an extra fee will be charged and they will be removed to a designated veterinary hospital. -- -This will not be a high transaction facility (average 77 /month). -- -The facility wall have continuous staffing, i.e. no animals will ever be present without a staff member present. -The hours listed in the conditions of approval are acceptable to the applicant. - -The present facility operates 5:00 p.m. Friday evening through 8:00 a.m. Monday morning. It is hoped that evening hours, Monday through Thursday, can be added at some future time. (An additional vet will be hired when these additional hours are added.) There being no further applicant or public comment the matter was placed before the commission. Ms. Huckle wondered if there would be parking conflicts caused by the proposed billard center (next agenda item). Mr. Fritz responded that the Zoning Administrator has determined that there is sufficient parking to accommodate both uses. Ms. Huckle expressed the hope that some parking spaces would be designated for the use of the veterinary clinic only. 10 -15 -91 9 Ms. Andersen moved that SP -91 -52 for Greenbrier Square Limized Partnership be recommended to the Board of Supervisors for approval subject to the fallowing conditions: 1. There shall be no outside exercise area. 2. No animals are to be confined outside. 3. Use is limited to 370 Greenbrier Drive. 4. Hours of operation shall be limited to: Monday - Thursday: 5:30 p.m. to 9:00 a.m.; 5:30 p.m. Friday until 9:40 a.m. Monday. 5. There shall be no scheduled appointments. Clinic shall accept animals only on an emergency basis. 5. Animals shall be permitted on site only during hours of operation. Mr. Wilkerson seconded the motion which passed unanimously.
