Moore - Balzer & Associates 1561 Commerce Rd, Suite 401 Verona, Va 24482 RE: SP200900029 Charlottesville Kingdom Hall Tax Map 76, Parcel 51 Dear Mr. Moore: On June 9, 2010, the Albemarle County Board of Supervisors took action on SP #200900029 to modify the layout of a previously approved special use permit (SP2008 -057) to include a new building and parking lot location on Tax Map 76 Parcel 51 in the Scottsville Magisterial District. This special use permit was approved subject to the following conditions: 1. The development of the site shall be in general accord with the concept plan entitled Kingdom Hall of the Jehovah's Witnesses prepared by Balzer and Associates, Inc., Sheet No. 1 of 1 dated 11 -16 -2009 (hereinafter, the "Concept Plan "). In addition, the following elements shall be in strict accord with [or "conform to "] the Concept Plan location of the area for sidewalk dedication and reservation of area for the extension of the Southern Parkway; 2. The area of assembly shall be limited to a maximum of one (1) auditorium with one hundred ninety (190) seats; 3. The final site plan shall show an area across the front of the site to allow the future installation of a sidewalk by others (the "sidewalk area "). The final site plan shall include a note reserving the proposed sidewalk easement and a five (5) foot right -of -way area for future dedication. The area for dedication shall allow for a minimum width of a five (5) foot sidewalk and which shall meet all applicable VDOT and County standards per Section 32.7.2.8 of the Zoning Ordinance. Upon request by the County, the sidewalk area shall be dedicated for public use. The owner shall grant all necessary temporary construction easements to allow the sidewalk to be installed; 4. There shall be no day care center or private school on site without approval of a separate special use permit; and 5. Construction of the development plan referenced in Condition 1 above shall commence by June 9, 2014 or this special use permit shall expire. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: • compliance with conditions of the SPECIAL USE PERMIT; • approval of and compliance with a SITE PLAN amendment; and • approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within forty -eight (48) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
