submitted.

Greg,
The last phone conversation I had with you about Elledge, we spoke about two issues:
1. Whether or not we could sign the site plan. I told you that to -date we had not signed it because the case was in
court and that I thought since Sinclair indicated he was going to appeal it, and it would still be "actively" in court,
that it would not be right for us to move forward and sign the plans. You said you didn't think there was any
reason why we couldn't sign it- that just because Sinclair was going to appeal it wouldn't prevent us from
moving forward signing the plans (and that there was no injunction active- did you call it a "stay " ?, as in there is
no stay on the property ?), but that you would get back to me to confirm.
Once I get word that we can definitely sign the plans, then Jerry could technically move forward with applying
for the building permit. However, you told me to advise Jerry to speak with AT &T's attorneys to double check to
make sure there was no "agreement" between the parties that AT &T wouldn't proceed with the building permit
until the court stuff was resolved.
Jerry called me back today to see if we had any updates or objections that would prevent them from being able to get
their site plan (and thus building permit). Jerry insists that at AT &Ts direction he was told to move forward with the
building permit and he didn't see the need to call their legal department to make sure there was no "agreement"
between the parties involved in the legal case.
Do you have any responses /updates for me? I am still nervous moving forward with signing the site plan until I have
something in writing from you advising me that I can.
