RE: Tax Map 37, Parcel 2, SUB 2010.— 85 Hoffman
Dear Mr. Ray
You have submitted a request for waiver of the building site shape as provided for by Chapter
18, Section 4.2.2 of the Albemarle County Code.
It is my opinion that:
(i) the parcel has an unusual size, topography, shape, location or other unusual physical
condition; The property is large and a ridge effectively separates the property into
two pieces.
(ii) no reasonable alternative building site exists; -- Alternative-building sites do exists.
However, it is my opinion that these building sites are not desirable and use ofthem
may not be reasonable due to the extensive presence of critical slopes. These slopes
would require disturbance (which is exempt from regulation) in order to install
access.
(iii) modifying or waiving the rectangular shape would result in less degradation of the
parcel or adjacent parcels than if those dimensions were adhered to —No critical
slopes, or very limited critical slopes will be disturbed in order to utilize the modified
building site. It is my opinion that the preservation of critical slopes results in
significantly less degradation to the site.
The waiver has been granted subject to the following condition:
Building sites shall. be limited generally to the areas shown on a sketch marked
"Approved Building Site. WDF 2/1/10" and sent to you on February 3, 2010.
Building shall not occur in the area shown as "Unapproved Building Site. WDF 2/1/10 ".
Building may occur in the areas immediately surrounding the approved building sites.
Please note that the designation of these sites as building site is as to general location only. You
must still obtain health department approval of drainfields.
