Section 31.2.4.1 of the Albemarle County Zoning Ordinance states that, "The board of supervisors hereby reserves unto itself the right to issue all special use permits permitted hereunder. Special use permits for uses as provided in this ordinance may be issued upon a finding by the board of supervisors that such use will not be of substantial detriment to adjacent property, that the character of the district will not be changed thereby and that such use will be in harmony with the purpose and intent of this ordinance, with the uses permitted by right in the district, with additional regulations provided in section 5.0 of this ordinance, and with the public health, safety and general welfare." How will the proposed special use affect adjacent property? The sign currently located on this property was put in place several years ago. The main sign facing Rt. 29N is in dire shape and does not list any tenants of the Shopping Center. The second sign, located near the Carmike Theatre on TM 045 - 010465, does list tenants, although it is also in poor condition. The intent is to coordinate two new signs that tie in the look and color of the existing Gardens buildings.The new signs will include updateable spaces for tenants, thus keeping the look consistent, cohesive and more professional, thus positively affecting the adjacent properties. How will the proposed special use affect the character of the district(s) surrounding the property? The proposed special -use will not affect the character of the district. The sign will be consistent with the look of other signs in the area or be an improvement on other signs adjacent Route 29, north of Rio Rd. How is the use in harmony with the purpose and intent of the Zoning Ordinance? The sign will identify Commercially -zoned Shopping Center which can be seen directly from Route 29. The new sign will advertise other commercially -zoned properties and will be within the limits set for sign area maximums in that district. How is the use in harmony with the uses permitted by right in the district? The sign will publicize a commercial Shopping Center which provides retail businesses a place to provide goods and services to the public, while helping strengthen the community's economic base. Examples include a home goods store (e.g., Pier 1), a day care facility (e.g., Little Gym), eateries (e.g. Thai 99) and a movie theatre (e.g., Carmike), among others. All of which are permitted by right in this district. 9/22/08 Page 2 of 4 1 What additional regulations provided in Section 5.0 of the Zoning Ordinance apply to this use? - Additional regulations of Section 5.0 do not apply to this special use. How will this use promote the public health, safety, and general welfare of the community? The addition of specific tenants to the Gardens Shopping Center tenant directories will allow clients and customers of listed businesses to have quicker and easier access to the business park with less confusion while driving on Route 29. Describe your request in detail and include all pertinent information such as the number of persons involved in the use, operating hours, and any unique features of the use: We would like to replace an existing sign on this property with a new sign which includes busi- ness tenants not located on the same parcel of land. The new sign will be 24 sq. ft., including the tenant directory and will not exceed that maximum. The section of tenant names will be easily updateable, by use of cast vinyl applique, which will keep the sign looking professional and consistent. The sign face will be a 72 "w x 48 "h painted aluminum cabinet, accented with white molding. The sign base will be a 72 "w x 19 "h aluminum cabinet and kick panel.
