RE: SUB2010 -109- Oscar and Anna Wood -14 -404 Waiver request
Ms. Dunnivan:
You have submitted a request for waiver of the requirements for a single point of access for a possible
division of the above referenced parcel. This access regulation and waiver criteria are found in Chapter
14, Section 404 of the Albemarle County Code.
In order to approve the waiver the following findings must be met:
In approving a waiver, the agent shall find that requiring the extension would not forward the
purposes of this chapter or otherwise serve the public interest; and granting the waiver would not
be detrimental to the public health, safety or welfare, to the orderly development of the area, to
sound engineering practices, and to the land adjacent thereto.
As a representative of the Agent, it is my opinion that the request meets the requirements for granting the
waiver in accordance with 14 -404 (D)(2)(ii) which states that the construction of a single point of access
would substantially impact features existing on the property prior to October 14, 2009. If only one access
were provided the existing garage would become inaccessible since the entrance for the garage is located
on the other side of where the single access would be required and would substantially impact existing
features on the property.
It is also my opinion that using two accesses would be consistent with the orderly development of the
property. The single access location would require more grading and tree removal on the property
therefore, two access points are consistent with sound engineering practices. No adverse impact on
adjacent property is anticipated, and therefore the waiver is granted.
