(See Attachment A) The variation may be approved administratively consistent with Section 8.5.5.3 of the Albemarle County Zoning Ordinance. You state, in part, that, "a 35' building separation is similar to the typical separation between the back walls of buildings in a conventional subdivision" and "the grass mall will include a pedestrian sidewalk and landscaping." Section 8.5.5.3 allows the Director of Planning to grant minor variations to yard requirements, build to lines or ranges provided that: 1) The variation is consistent with the goals and objectives of the comprehensive plan. The proposed variation supports the Neighborhood Model in providing pedestrian orientation; and neighborhood friendly paths, buildings and spaces of human scale. 2) The variation does not increase the approved development density or intensity of development. The density in Block 3B and the density of the entire development will not change. 3) The variation does not adversely affect the timing and phasing of development of any other development in the zoning district. The variation will not adversely affect the timing and phasing of this section of Old Trail or any other development in the zoning district. 4) The variation does not require a special use permit. The variation does not require a special use permit. 5) The variation is in general accord with the purpose and intent of the approved rezoning application. The variation allows for flexibility in layout of the site without compromising safety and is in general accord with the purpose and intent of the approved Old Trail zoning. With the above findings, a variation allowing a grass mall with a minimum separation of 35' between the faces of buildings is hereby granted for Block 3B of Old Trail Village (SUB 2010 -064) subject to the following: 1) The pedestrian sidewalk will be located in the middle of the grass mall, roughly an equal distance between the faces of buildings. 2) The buildings will not exceed 2 stories in height on either side of the grass mall. Please note that development under this request is still subject to all other applicable zoning, subdivision and building permit provisions and this variation does not supersede those requirements. Describe the variation being sought (may attach separate sheets): Allow a grass mall within Block 3B, with a minimum separation between faces of buildings of 35', as shown on attached exhibit. What is the reason for each of the requested variations ?: The Code of Development for Old Trail Village allows units to front on a "grass mall" in lieu of frontage on a public or private street. No standards were established for minimum dimensions of a grass mall, therefore Zoning staff made a discretionary decision that grass malls should be a minimum width of 50'. This section of Old Trail was designed to separate the buildings facing the grass mall by a minimum of 35', with the understanding no minimum dimensions for grass malls existed. The units involved are accessed from the rear via private accessways, which function similar to private roads. A 35' building separation is similar to the typical separation between the back walls of buildings in a conventional subdivision. The grass mall will include a pedestrian sidewalk and landscaping, functioning as a shared yard for community recreation and gathering. This proposed design exemplifies the goals of the Neighborhood Model. Please provide information about these criteria for the Director's consideration (may attach separate sheets). 1. Is the variation consistent with the goals and objectives of the comprehensive plan? yes - this is consistent with the goals of the neighborhood model district to make open space integral to the overall design of neighborhoods and provide a central community gathering space. 2. Does the variation increase the approved development density or intensity of development? No. The density approved remains unchanged. 3. Does the variation adversely affect the timing and phasing of development of any other development in the zoning district? This proposed change has no impact on the phasing or timing of any portion of the development of Old Trail Village. 4. Does the variation require a special use permit? The proposed change does not require a special use permit. 5. Is it in general accord with the purpose and intent of the approved rezoning application? The Neighborhood Model District approved for Old Trail Village intended to create pedestrian friendly streets and neighborhoods where vibrant activity among residents would be fostered by thoughtful design. This proposed plan enables this vision to become reality. § 8.5.5.3 VARIATIONS FROM APPROVED PLANS, CODES, AND STANDARDS OF DEVELOPMENT The director of planning and community development may allow a site plan or subdivision plat for a planned development to vary from an approved application plan, standard of development and, also, in the case of a neighborhood model district, a general development plan or code of development, as provided herein: a. The director is authorized to grant a variation from the following provisions of an approved plan, code or standard: 1. Minor variations to yard requirements, maximum structure heights and minimum lot sizes; 2. Changes to the arrangement of buildings and uses shown on the plan, provided that the major elements shown on the plan and their relationships remain the same; 3. Changes to phasing plans; 4. Minor changes to landscape or architectural standards; and 5. Minor variations to street design. d.
