REQUEST FOR CRITICAL SLOPES WAIVER
Dear Ms. Frederick:
My records indicate a Critical Slope Waiver was previously submitted to Jack Kelsey
(dated June 6, 2006). However, I cannot confirm if that request was approved. Therefore,
as requested, please accept this letter as a Critical Slopes Waiver Request to allow minimal
impacts to critical slopes located within the development of Wickham Pond Phase 11.
The following are the critical slope calculations for the site:
Total site area 19.69 acres
Total area of critical slopes on site 1.07 acres (5.4 % of total site area)
Total area of critical slopes impacted 0.03 acre (2.8 % of total critical
slopes on -site; 0.15 % of total site area)
These minimal proposed impacts are necessary to provide sewer facilities to serve all units
within the proposed development, preserve as many existing trees as possible, provide an
interconnected road network consistent with the Neighborhood Model, and to meet the
County goals for development of this CT -3 Crozet Master Plan designated parcel.
The following analysis addresses the five issues described in Section 4.2 of the Albemarle
County Code regarding potential effects of impacting critical slopes.
1. Rapid and/ or large -scale movement of soil and rock:
The proposed critical slope impacts have an area of approximately 1,383 SF (0. 03 AC) and
are located mostly within natural eroding stormwater runoff channels on the property. They
are isolated and to meet the County's goals for development on this parcel, they will need
to be impacted. Of the total 19.69 acres within this planned development area, only 0.03
acres of critical slope impacts are proposed, corresponding to less than 1% of the total
project area. By general industry standards, this level of impact is not considered large -
scale and the isolated nature of the critical slopes will allow for controlled grading of these
areas.

2. Excessive Stormwater runoff:
Stormwater management facilities shall be implemented during construction throughout the
project to control runoff in a manner meeting State and County E &S requirements. As
mentioned above, the isolated nature of the critical slopes will allow for controlled grading
of these areas.
3. Siltation of natural and man -made bodies of water:
If left unimproved, the existing channel where critical slopes exist will continue to erode.
Eliminating these critical slopes will remove this source of silt and downstream bodies of
water should experience less silt deposits from this property. During the construction
process, erosion control measures will be implemented meeting State and County E &S
requirements. Once improved, open spaces will be planted to reduce erosion and minimize
siltation.
4. Loss of aesthetic resource:
Wickham Pond Phase H has been designed to preserve existing natural resources, including
all areas within the stream buffers. A hedgerow will be planted and maintained along the
property frontage to minimize visual impacts to the Route 240 Entrance Corridor. The
critical slopes are not visible beyond the limits of the property and are simply the result of
localized erosion within a stormwater runoff channel; therefore, impacting these critical
slopes will not result in a loss of an aesthetic resource.
5. In the event of septic system failure, a greater travel distance of septic effluent:
All residences at Wickham Pond H will be served by a public sewer system, therefore
septic system failures are not a concern. Existing septic systems present on the property
will be abandoned or removed in accordance with County Health Department
requirements.
Based on the calculations and explanations provided herein, the minimal critical slope
impacts requested will not constitute potential dangers to the public health, safety and/or
