Hoy McGuireWoods LLP 1750 Tysons Blvd., #1800 McLean, VA 22102 RE: Rio Hill Shopping Center Tax Map 45, Parcel 94A The First Interstate Charlottesville Limited Partnership (Owner) Dear Ms. Hoy: You have asked for a letter that provides an analysis of the zoning and other information regarding the referenced property. This letter is based on a review of our records and an inspection of the site. The property is zoned Planned District- Shopping Center- PD -SC and is in the Entrance Corridor overlay district - EC and the Airport Protection overlay district - AIA. The property is developed as a shopping center which contains a variety of uses that are permitted by right in the C-1, C -O and HC districts, all of which are permitted by right in the PD -SC district. The Board of Supervisors approved the rezoning of the property to PD -SC in 1987 subject to modifications and conditions. A copy of the approval letter associated with ZMA-1987-007 is enclosed. The Board of Zoning Appeals approved a variance in 1993 to allow the height of the wall sign for Kroger's to increase from 20 to 27 feet. A copy of the action letter for VA -1993-004 is enclosed. The property is developed in accord with the application plan approved with the rezoning and the site development plan first approved on March 24, 1988. The site plan has been revised several times since. These plans indicate the current buildings comply with height, setback, lot coverage, parking, and FAR requirements for the PD -SC district. One site plan violation was identified. There are a number of storage containers located at the rear of the facility that are not shown on any site plan. These must be removed or shown and approved on an amended site plan. No other violations were identified. We have no record of any unresolved zoning violations or pending notices of zoning violations for the property apart from the issue of the storage containers. We have no record of any unresolved building code violations or pending notices of building code violations for the property. The plat of record in Deed Book 3116, pages 306 — 308 was approved by the County on April 29, 2005. The plat created a parcel designated as "Out Lot D" containing 1.213 acres and easements. As a result of this transaction the residue of the subject property contains 30.986 acres. Out Lot D is now identified as Parcel 94A1 on Tax Map 45. It is the policy of this department to purge building permit files after three years. Copies of Certificates of Occupancy are maintained on microfilm. Therefore, we have not retained any copies of Certificates of Occupancy associated with this project. Furthermore, the absence of a Certificate of Occupancy for the project will not give rise to any enforcement action. Please be aware that interior renovation that does not involve a change of use does not require a Certificate of Occupancy. You may obtain a copy of a Certificate of Occupancy for an additional fee of $25.00 each. Please contact me if you have any questions.
