HomeMy WebLinkAboutZTA201000004 Legacy Document 2010-12-07 (3)ATTACHMENT B Noxious and Hazardous Uses Background: Staff is continuing to review and analyze the individual uses that currently exist in both the Light Industrial (LI) and Heavy Industrial (HI) Districts in order to better allow for new uses and preservation of existing uses by providing broad industrial use categories. However, certain uses need to be identified separately due to the fact that they are considered hazardous or otherwise appear incompatible with other uses. In addition, staff will be drafting new and /or revised supplementary regulations which apply to the development and operation of these types of uses in the next phase of the industrial zoning text amendments. Supplementary regulations can establish standards for setbacks and buffering, separations from existing residences, reduced hours of operation and the like. At this point staff has identified the following uses which by their potentially noxious and /or hazardous nature should remain separately identified: a) Dry Cleaning Plants (by -right in HI), b) Abattoirs (by SP in HI), c) Petroleum, gasoline, natural gas and manufactured gas bulk storage (by -right in HI) and d) Petroleum refining, including by- products (by SP in HI). It should be noted that all of the uses are subject to separate state, federal and local regulations. In addition, changes are recommended for Abattoirs for the reasons stated below. Abattoirs are more commonly known as slaughterhouses. Historically, slaughterhouses may utilize all animal parts, some of which is for consumption as food and some of which is waste or byproducts either processed at the slaughterhouse or removed from the site for processing. The processing of the waste or byproducts is known as rendering. This use can cause noxious odors and potential health concerns. Recommendation: Staff proposes updating the term "Abattoir" to "Slaughterhouse ". Staff further proposes permitting Slaughterhouses that do not involve rendering as by -right in Hl, while permitting those that involve rendering and stand -alone rendering plants only by SP in Hl.
