Albemarle County recently received the request described below. You are receiving this notification
because you are the owner or agent of abutting property or property immediately across the street from
the site under review. The location of the site under review is shown on the attached vicinity map.

PROPOSED: Placement of fill in the floodplain to allow road construction.
ZONING CATEGORY /GENERAL USAGE: R1 - Residential - low density residential uses, EC Entrance
Corridor - Overlay to protect properties of historic, architectural or cultural significance from visual impacts
of development along routes of tourist access, AIA - Airport Impact Area - Overlay to protect the airport
and FH - Flood Hazard - Overlay to provide safety and protection from flooding SECTION(S):
30.3.05.2.1 (2), 30.3.05.2.2 (1) and 30.3.05.2.2 (3), which allow filling of land in the floodway

Morey Creek near its confluence with Moores Creek. The property is located on the west side of Sunset

This letter is an initial notification that the project is under review by the County.
The Planning Commission will hold a public hearing when the applicant advises staff that he /she is ready
for a public hearing. The Planning Commission will consider the staff's recommendation at this public
hearing. The Board of Supervisors will consider both the staff's and Planning Commission's
recommendation at a subsequent public hearing. The Board of Supervisors ultimately makes the
decision to approve or deny this proposal.
The County will send you another letter notifying you of the public hearing dates approximately three (3)
weeks before the hearing. A notice will also appear in the classified section of the Daily Progress at
approximately the same time. Notifications are not sent for worksessions; however, the agendas for each
Planning Commission meeting may be found on -line at this address: www.albemarle.org under the
Planning Department tab.
All information pertaining to the proposed development is available for review in the Community
Development Department during normal business hours (8 a.m.- 5p.m., Mon -Fri). To assure the
information is ready for your viewing and to allow staff to be available to help with any questions, we
encourage you to schedule a viewing time. Please call 296 -5832 ext 3070 during business hours to
schedule an appointment. While an appointment is not required, we do give priority to those with
appointments. Those without appointments may find the materials are in use by others and /or staff is not

Dear Mr. Collins:
Albemarle County recently accepted your request for a special use permit or rezoning for the project
referenced above.
Staff will perform its initial review of your proposal and provide a set of written comments by December
30, 2010. After this initial set of comments is provided to you, you may request a meeting with other staff
and myself to review the comments. If we have provided comments which indicate the need to resubmit,
please resubmit within 30 days of the date of the comments.
If you plan to resubmit to address staff comments, please resubmit on a resubmittal Monday. Resubmittal
Mondays are the 1St and 3rd Mondays of each month. You can find the 2010 Resubmittal Schedule as
well as a tentative Planning Commission hearing date which corresponds to the resubmittal date online at
www.albemarle.org should a resubmittal be necessary. Resubmittals are not necessary if only small
changes are needed from the initial submittal, such as a minor change to an existing special use permit
condition or proffer. Please be advised that the Planning Commission date is a "no sooner than" date and
is subject to the Commission's schedule.
If staff has not heard from you within a 30 day period of receiving your initial comments, staff will follow up
with a second letter requesting that you: request withdrawal of their application, or request deferral of
their application to a specific Planning Commission date as mutually agreed to with staff, or request
indefinite deferral and provide justification for this request. If staff does not hear from you after the
second letter, staff will schedule your application for public hearing with the Planning Commission with a
recommendation based on the information in hand at that time.
A public hearing date with the Planning Commission will be set after you have received written comments
from each submittal and have advised us that the project is ready for a public hearing.
