HAMILTON LICENSED LAND SURVEYOR My clients, Mr. Allen Powell and Ms. Janet Pitt, are the contract purchasers of a portion of property belonging to Ms. Agnes M. Fotta. The purchasers and owner want to pursue the division of Tax Map 9, Parcel 19. The proposal is to create a single, new lot in the northeastern portion of the property that lies in Albemarle County. The new lot would be on the opposite side of the creek from the existing house and driveway and a private street is proposed that would access the public street, Silvia Ridge Road, in Greene County. Sylvia Ridge Road, State Route 602, is a secondary, dead end street. The residue property of Ms. Fotta will continue to use the existing driveway. In accordance with Chapter 14, Section 232 of the Code of Albemarle, the above applicants hereby request approval of a new private street. We feel a private street will best serve this new lot. The following circumstances exist which make this request worth considering: • The property lies in the Rural Area district • The proposed new lot and home site lies at a distance of approximately 1,500 feet from the existing driveway. Since it would necessitate a crossing of the creek, the private street will alleviate a clearly demonstrable likelihood of significant degradation to the environment caused by erosion and sedimentation, storm water runoff, surface water pollution, loss of tree cover and /or the loss of indigenous vegetation resulting from construction of a public street in the same alignment. This impact would be for both the subject property and that of downstream land adjacent thereto. 78 MAIN STREET. STANARDSVILLE (434) 985 -8200 Dclis Attachment Page Two Mr. Bill Fritz, Chief of Current Development RE: Division of Tax Map 9, Parcel 19 • The alternative public street, Silvia Ridge Road, in Greene County would be accessed from the new private street at a distance of approximately 700 feet, lessening the construction impact by more than 50 %, and this alignment would alleviate the likelihood of significant degradation of the environment. • The proposed private street would demonstrably promote sensitivity toward the natural characteristics of the rural, agricultural land and encourages the subdivision of land in a manner that is consistent and harmonious with that surrounding development. As we are requesting approval of the private street and the resulting two lots will not share the same entrance onto the public street, we also request a waiver of Chapter 14, Section 404 of the Code of Albemarle. I have included a sketch of the property which shows the existing driveway and improvements and the proposed private street and residence. The basis for this sketch was taken from the Albemarle County GIS mapping. We appreciate your consideration of this request.
