Dear Mr. Crews,
Thank you for the recent submittal for these special use permit applications. Please find review
comments included in this letter.
Please see the attached resubmittal schedule for a list of dates on which you can submit your
revisions and responses to review comments (below and attached), as well as for possible
Planning Commission dates (please note that the listed dates are the earliest possible, but actual
dates need to be selected to suit the revision schedule for each project.)
COMMENTS
Zoning (Amelia McCulley]
This review is for both special use permits. I have reviewed this initial submittal and have the
following comments:
1. The applicant will need to determine whether he will be trying to change the flood
maps for this property, such that it is not floodway but may include floodway fringe
or whether he is proceeding with the current floodplain designation. The former is a
fairly expensive proposition that involves hiring an engineer and paying FEMA
review fees. I'm assuming he is proceeding with the current designation. He will
need to satisfy the ordinance requirements that the structures and any other work or
fill in the floodplain will not cause a rise in water surface elevations.
2. The issue relating to the WPO buffer will need to be resolved. Based on our meeting
with the County Engineer and Deputy County Attorney, it seems that the applicant
will need to provide information proving that there was a prior structure and use on
the property such that the proposal would fall within the WPO exception. (Please
follow comments from the County Engineer on this.)
3. The proposed septic field and structures will require a Planning Commission waiver
of building site requirements (Section 4.2.1 with waiver in Section 4.2.5).
4. We will need a more detailed sketch plan to more adequately review this proposal.
We also need more details about proposed improvements. The use of structures is
limited due to the FHOD designation of this property. Based on discussion with the
County Attorney, we'd previously discussed the fact that a minimal building to
transact business and a bath house would be permitted. This will need to be
formalized in later comments.
County Engineer (Glenn Brooks)
These properties are entirely in the Floodway and the WPO Buffer. New Buildings and
septic systems cannot be permitted without an exception or exemption. Such an exception
or exemption would need to be granted by the Board of Supervisors before these permits
could be approved.
Grading is not permitted in the Floodway. Disturbances or impervious areas are not
permitted without mitigation according to the WPO.
Current Development — Planning (Bill Fritz)
This use will require a site plan as it involves a new entrance and parking. Waivers from
the parking standards will be required (Section 4.12) and the applicant may want to seek
a site plan waiver (Section 32.2). A site plan waiver is not a waiver of the need for a site
plan - -it is only a reduction in the level of detail required to be shown on the site plan.
Please be aware that no site plan (including a site plan waiver) can be approved without
Health Department approval. As this site is entirely within the floodplain I question the
ability of the applicant to obtain health department approval.
No building permit of any kind can be approved on this property. This is because no
building site exists on the property. The sketch plan shows at least one building on this
property. If the applicant intends to build they should seek a waiver from Section 4.2.3
(Section 4.2.5 contains the waiver provisions.)
I will contact Amelia McCulley to determine if other improvements on the site must also
be included in any waiver request.
Planning (Scott Clark)
Camp rog und:
o Please provide details on how the sewage from the recreational vehicles would be
disposed of.
o What facilities (electric, water, other ?) would be provided in the RV sites?
o Would the RV sites and the access road to the tent sites be paved, or would they
have gravel or some other surface?
o Would the tent sites require any clearing of trees, and would there be any facilities
(graded pads, access driveways, picnic tables, fire rings /grates, grills, etc.)?
o Would there be a limit on the number of persons or vehicles in each tent site?
o Would the campground offer any programs that would involve amplified sound,
lighting, or other possible impacts on adjacent properties? This is especially of
concern at night.
• Do you have any plans for outdoor lighting in the campground, or
• Would you object to a condition requiring that the campground be staffed 24
hours a day to make enforcement of the "quiet time" more effective?
• Please show the existing and proposed (post- development) tree lines on the sketch
plan.
Canoe Livery:
• How would canoeists be transported to or from put -in or take -out points?
• Would vans, trucks, trailers, etc. for transporting canoeists and canoes be stored
on the property outside of operating hours?
Virginia Department of Health
Comments from the Health Department have not yet been received. Please provide
documentation showing that the Health Department will be able to approve your
proposed water - supply and septic - disposal systems. Please contact Mr. Josh Kirtley at the
Charlottesville office of the Department of Health as soon as possible, so that you can
describe your proposed operations to him and get his advice on how to proceed with
planning for water - supply and septic issues.
Virginia Department of Transportation (Joel Denunzio)
