The application fee for this project has not been submitted. No further review will be performed until the fee has been submitted. The fee for this type of application is $1,120 (reference Chapter 14, Sections 203(A)(2)(a), 203(B)(2)(a), 203(G)(2) and 203(B)(3) of the Code of Albemarle. A fee of $95 has been paid leaving a balance of $1,025 due. 2. Health Department approval is still required. 3. Sight distance easements are required according to VDOT email of 2/19/10. 4. Stream buffer must be shown on the plat with the appropriate notation regarding protection of the buffer. (See comments from Amy Pflaum dated 12/1/09). 5. Private street maintenance agreement is required. 6. All of Elizabeth Marotta's comments of 12/4/09 must be addressed. (Comments attached) If you have any questions please contact me. (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated bases upon further review.) Each comment is preceded by the applicable reference to the Albemarle County Code. 1. [Sec. 14- 302A15] Identification of all owners and interest holders. COMMENT: Per this section, provide address of owners. 2. [Sec. 14- 302137] Agricultural forestal district. COMMENT: Please revise note to read "The property shown herein is not located in an Albemarle Agricultural- Forestal District." 3. [Sec. 14- 30213101 Stream buffers note. COMMENT: According to Albemarle County GIS, the stream on this property has an associated Water Protection Ordinance Buffer. Show limits of buffer and provide the note verbatim, as required by this section. 4. [Sec. 14 -303E] Dimension standards and information. COMMENT: Please label the proposed new street easement as "New 30' private street easement ". 5. [Sec. 14 -303R] Private road in rural areas. COMMENT: Provide note verbatim as required by this section. 6. [Sec. 14- 308.1] Groundwater assessment information. COMMENT: a Tier II groundwater assessment fee is required. Please submit the $330 fee with your resubmittal. 7. [Sec. 14 -303L, 14 -316] Approval of entrance on public streets. COMMENT: VDOT approval of is required. Sight distance easement may be required. 8. [Sec. 14 -317] Instrument evidencing maintenance of certain improvements. COMMENT: Submit a Private street maintenance agreement for review and approval. COMMENT: Please provide control points as required by this section. 10. [Sec. 14 -400] Minimum lot requirements. COMMENT: Provide setback lines and dimensions on the plat to ensure existing buildings conform to setback/yard requirements. 11. [Sec. 14 -404, 14 -306] The proposed private street easement across TMP 8 -33C creates a situation where the subdivision now includes 3 lots and the private street is technically serving three lots, resulting in the need for Planning Commission approval of the proposed private street (Sec. 14 -232) and the need for a waiver of Sec. 14 -404. Section 14 -404 states that a lot may only be served by one street created at the time of the subdivision. Because TMP 8 -33C would not gain sole access from the proposed private street easement, a waiver would be required. You have two options. You may either do a boundary line adjustment between TMP 8 -33C and TMP 8 -34C so that the new private street easement is entirely within TMP 8 -34C, OR, you may request a waiver of Sec. 14 -404 (per Sec. 14 -404C) and request private street authorization from the Planning Commission as set forth in Sec. 14 -306. 12. [Sec. 14 -420] Location of utilities. COMMENT: Label all utilities shown on the plat.
