I thought it might be helpful to provide background information to explain the request. I assume this application would be assigned to you since you handled the most recent proffer amendment for the Project. The buildings in Block E are apartments and were originally planned for Phase 2 of the Project. For various reasons, the Owners would like to have the flexibility to construct the Block E buildings either as part of Phase 1, or just after Phase 1 but before the other Phase 2 blocks (F and G) and before the final alignment of the second phase of Albemarle Place Boulevard is in place. Representatives of Edens & Avant have been discussing this proposal at length with Mark Graham and Wayne Cilimberg, and we had a meeting with Mark, Wayne, Amelia McCulley and Gerald Gatobu on this issue several weeks ago. If the Block E buildings are built before the final alignment of the second phase of Albemarle Place Boulevard is in place, the Owners would likely build a temporary road in a slightly different location than as shown on the Application Plan) to provide a connection to the new planned intersection at Albemarle Place Boulevard and U.S. Route 29. Then, when the remainder of Phase 2 is constructed (Blocks F and G), the temporary road would be replaced by the permanent road in the final location shown on the application plan. This proposed amendment to the proffers is contained in paragraph 1B of the proffers, and was worked out with Mark, Wayne, Amelia and Gerald at our recent meeting. One other proposed change, which Amelia suggested, is contained in paragraph 13, and involves the "Super Block" Street Connections. Since the proffer amendment was approved in August, 2010, the Albemarle Place engineers have been working on the revised preliminary site plan for the project with Gerald. As such, Amelia suggested that we delete reference to the connection at Second Street, and that we add a sentence making it clear that the County can permit the locations and numbers of such inter -parcel connections to be modified by the Owner. For your convenience I have included the proposed proffers in both blackline and "clean"/non-blackline formats. I realize this is a bit confusing, particularly when you have not been party to the discussions about this issue. I would be happy to schedule a meeting with you and any other members of the County staff that you think would be helpful, to discuss the reasoning for the proffer change in greater detail and so that we may address any questions you may have about the proposal. Please note that in addition to the three revisions requested by your cover letter, I also corrected a typo in paragraph 2 which referenced the wrong Virginia Code Section. As I mentioned in my voicemail message to you, this was never intended to be changed from the way it was written in the 2003 approved proffers, I believe it was accidently modified when the PDF version of the 2003 proffers was converted to a word file -- we corrected a number of similar errors at the time, but we missed this one. Staff has no recommended substantive changes to the proffers and recommends only minor wording changes as follows: 1. Change the date and ZMA # at the beginning of the proffers. 2. Change two references in your proposed changes to proffer 1. B. Phase 2. from "acceptable to the County" to "acceptable to Director of Community Development". 3. Change your proposed changes to proffer 13. from "upon the consent of the County Planning Director" to "upon a variation granted by the County Planning Director". Staff is prepared to schedule a public hearing of the Planning Commission upon resubmittal of these recommended changes to the proffers and payment of the fees noted below. Be sure to include the resubmittal form on the last page of your comment letter with your submittal. The application fee which you paid covers staff review of the initial submittal and one resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.) (2) Request Indefinite Deferral If you plan to resubmit after 30 days from the date of the comment letter, you need to request an indefinite deferral. Please provide a written request and state your justification for requesting the deferral. (Indefinite deferral means that you intend to resubmit/request a public hearing be set with the Planning Commission after the 30 day period.) (3) Request Planning Commission Public Hearing Date be Set At this time, you may schedule a public hearing with the Planning Commission. However, we do not advise that you go directly to public hearing if staff has identified issues in need of resolution that can be addressed with a resubmittal. After outstanding issues have been resolved and/or when you are ready to request a public hearing, staff will set your public hearing date for the Planning Commission in accordance with the Planning Commission's published schedule and as mutually agreed by you and the County. The staff report and recommendation will be based on the latest information provided by you with your initial submittal or resubmittal. Please remember that all resubmittals must be made on or before a resubmittal date. By no later than twenty-one (21) days before the Planning Commission's public hearing, a newspaper advertisement fee and an adjoining owner notification fee must be paid. (See attached Fee Schedule) Your comment letter will contain the actual fees you need to pay. Payment for an additional newspaper advertisement is also required twenty-two (22) days prior to the Board of Supervisors public hearing. These dates are provided on the attached Legal Ad Payments for Public Hearings form. Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning Commission's public hearing will be allowed during the life of the application. The only exception to this rule will be extraordinary circumstances, such as a major change in the project proposal by the applicant or more issues identified by staff that have not previously been brought to the applicant's attention. As always, an applicant may request deferral at the Planning Commission meeting. (4) Withdraw Your Application If at any time you wish to withdraw your application, please provide your request in writing. Failure to Respond If we have not received a response from you within 30 days, we will contact you again. At that time, you will be given 10 days to do one of the following: a) request withdrawal of your application, b) request deferral of your application to a specific Planning Commission date as mutually agreed to with staff, or c) request indefinite deferral and state your justification for requesting the deferral. Virginia State Code requires that notice for public hearings be made by publishing a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees for public notice are required before a Zoning Map Amendment may be heard by the Board of Supervisors. The total fee for public notice will be provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body.
