Dear Mr. Richmond:
The County Attorney and I have reviewed the title information for the above -noted property. It is
the County Attorney's advisory opinion and my official determination that Tax Map 25, Parcel 27
is comprised of all or part of four (4) parcels of record with sixteen (16) theoretical development
rights. The basis for this determination follows.
Our records indicate Tax Map 25 Parcel 27 contains 215.645 acres and zero (0) dwellings. The
property is in the Sugar Hollow Agricultural and Forestal District.
The most recent deed for this property, recorded prior to December 10, 1980, the date of
adoption of the Zoning Ordinance, is recorded in Deed Book 401, page 439 and is dated
September 3, 1964.

identified to be part of Tax Map 25
Parcel 27 leaving residue acreage in
TMP 25-27 of 401.88 acres. The plat
did not identify Development Rights
being transferred with the 24 acres
but did state that TMP 25-27 has 5
division rights. The 24 acres did
come from the 127 acre parcel
identified above which has been
determined to be a separate parcel.
Thus no development rights for any
parcel of record that made up TMP
25-27 in 1987 were transferred with
this plat.

boundary adjustment removed 38.3
acres, 0.08 acres and added 0.6
acres. It has been determined that
the subtraction of the 0.08 acres and
the addition of the 0.6 acres involved
the 104 acre portion of TMP 25-27.
It has been determined that the
subtraction of the 38.3 acres
involved the 205 acre portion. Also,
the plat clearly shows a 40.518 acre
portion of a 43.243 acre tract being
added to what is determined to be
the 205 acre portion of TMP 25-27.
The plat notes show that TMP 25-27
was left with 368.52 acres. That
number did not incorporate the
40.518 acres to the total of TMP 25-
27.

On the basis of these deeds Tax Map 25, Parcel 27 is determined to be comprised
of a 104 acre+- parcel containing five (5) development rights, a 2.5 acre parcel
containing one (1) development right, an unknown acreage (See MAP D) of the
205 acre portion of TMP 25-27 containing five (5) development rights, and an
unknown portion (See MAP D) of a parcel that was once 127 acres containing five
(5) development rights. See attached map that identifies these acreages.
The parcel is entitled to the noted development rights if all other applicable regulations
can be met. These development rights may only be utilized within the bounds of the
original parcel with which they are associated. These development rights are theoretical
in nature but do represent the maximum number of lots containing less than twenty one
acres allowed to be created by right.

If you are aggrieved by this determination, you have a right to appeal it within thirty days
of the date notice of this determination is given, in accordance with Section 1.5.2-2311 of
the Code of Virginia. If you do not file a timely appeal, this determination shall be final
and unappealable. An appeal shall be only by filing with the Zoning Administrator
and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the
appeal. An appeal application must be completed and filed along with the fee of $240.
The date notice of this determination was given is the same as the date of this letter.
