Re: Determination of Development Rights — Michael and Lynne Levine;
TMP 23-7
Dear Mr. Shepherd:
We believe the above -referenced tax parcel in Albemarle County has 8
development rights calculated as set forth below. TMP 35-41, also acquired by Michael
and Lynne Levine pursuant to the same deed, does not have any development rights as
shown on the enclosed subdivision plat of Roger Ray dated July 16, 1997 as lot D-1. Nc
request is being made with respect to this other parcel. Therefore, we believe all 8
development rights are from the 75.59 acres of TMP 23-7, and are requesting a
determination of development rights with respect to that parcel only. We enclose the fee
of $40.00 for the determination of development rights of TMP 23-7.
The last instrument of record for TMP 23-7 prior to December 10, 1980 that
includes a plat or metes and bounds description is a Deed dated September 26, 1975 from
Stephen Harris and Jerold Freier, as grantors, to John and Sandra Correnti, as grantees
and recorded in Deed Book 582 Page 112. This Deed transfers 96.26 acres, as described
on the plat of Thomas Blue dated March 1, 1968, a copy of which is enclosed. Of the
total of 96.26 acres, 75.59 acres are in Albemarle County and the remaining 20.67 acres
are in Orange County.
This same 96.26 acres was next transferred by Mr. and Mrs. Correnti to Page F.
Craw pursuant to a Deed dated January 21, 1997 and recorded in Deed Book 1590 Page
364. Finally, Page F. Craw transferred this same 96.26 acre parcel to Michael and Lynne
Levine pursuant to a Deed dated November 2, 1999 and recorded in Deed Book 1874
Page 275. We have highlighted the relevant portion of the property description in this
Deed. There are no other plats or deeds of record with respect to this parcel.

The entire 75.59 acres in Albemarle County has not been previously subdivided at
any time since December 10, 1980. Therefore, the parcel has 5 division rights of lots of a
minimum of 2 acres each. Assuming the minimum lot size, there remains 65.59 acres,
into which 3 lots of a minimum of 21 acres each could be divided, or a total of 63 acres.
This brings the total to 5 plus 3, or 8 total development rights.
