We enclose the fee of $40.00 for the determination of development rights of TMP 59-25. The last instrument of record for TMP 59-25 prior to December 10, 1980 that includes a plat or metes and bounds description is a Deed dated September July 1, 1949 from Charles Slaughter and Hazel Burnham Slaughter, as grantors, to Eben C. Speiden and Muriel B. Speiden, his wife, as grantees and recorded in Deed Book 284 Page 451. This Deed transfers approximately 40 acres, as described on the plat of Hugh F. Simms dated December 1936 and recorded in Deed Book 234 Page 60, a copy of which is enclosed. The interest of Muriel B. Speiden passed to Eben Speiden by right of survivorship upon the death of Muriel B. Speiden in 1953. This land was inherited by Irene Higgins Speiden, the wife of Eben C. Speiden, by Will dated April 26, 1967 and recorded in Will Book 50 Page 495. This land has not been otherwise transferred since that date. The entire 40.27 acre parcel has not been previously subdivided at any time since December 10, 1980. Therefore, the parcel has 5 division rights of lots of a minimum of 2 acres each. Assuming the minimum lot size, there remains 30.27 acres, into which lot of a minimum of 21 acres could be divided. This brings the total to 5 plus , or 6 total development rights. Best regards.
