Associates 3040 Avemore Square Place Charlottesville, Va. 22911 Re: Albemarle Place (aka Stonefield) WP02010 -00023 Dear Herb, I have reviewed your resubmittal of March 18'' against the comments previously supplied by Phil Custer of this office. Based on that review, I am approving the referenced plan subject to the following conditions: 1. Per comment #4 from March 18th, approval of this plan and the Erosion and Sediment Control Plan associated with a final site plan shall require a determination that Minimum Standard 19 (per Va. E &SC Regulations) has been satisfied. As noted in this comment, that analysis shall be undertaken following a review by the City of the downstream channel analysis. I appreciate you forwarding the inspections video of the 42" pipes under Route 29. While the video illustrates a number of minor seeps affecting the long -term life of the structures, I saw no evidence of problems that would suggest this project would create an immediate threat to the stability of the structures. 2. Prior to issues of approval for a final site plan utilizing this storm-water management plan, a stomwater management agreement and bond that satisfies the County Engineer and County Attorney must be accepted by the County. I have not calculated a bond amount at this time, but will do so as part of the review of the final site plan. If you require a bond estimate in the near term, please let me know. Finally, while not a condition of approval, I do want to note several issues that I believe are important to you and your client. A. Please note that a large amount of the proposed storm sewer appears to be at depths that may exceed the rating for Class III RCP. I assume either you or the construction manager will address this depth to pipe classification prior to installing any of the structures. B. Without a site plan showing the location of buildings in relationship to the storm sewer is possible at this time. Related to "A." above, it is not possible to determine if the pipes are in the load plane of any building foundations. Please be prepared to address this issue during review of the site plans. C. Given the development is largely commercial in nature, we anticipate all of the onsite stomrwater management facilities and storm sewer will remain the responsibility of the property owner. The stormwater management agreement(s) will provide the County the ability to enter the site for inspections and/or repairs if the owner fails to provide those repairs, but the facilities shall remain the responsibility of the property owner. D. Finally, while I believe this plan can be constructed, it is a complicated plan and will require a lot of careful coordination during construction. The County's focus in on assuring compliance with the approved plan and public safety, not construction procedures. To this end, we encourage the construction manager to work closely with the County inspector to assure no permit violations are created during construction. We all understand that this project's proximity to Route 29 creates a risk of serious impacts to public safety and welfare from a failure. Thus, the inspector will be visiting this site more often than most and will expect the contractor to maintain site integrity at all times.
