BACKGROUND:
The applicant, Melody Day is requesting a Home Occupation Class A (HOCA) modification for the number of
trips generated by the HOCA use. The applicant is a voice and piano teacher and operates within her home.
The applicant is requesting an increase from seven (7) students per week to up to twenty (20) students per
week.
Characteristics of the current operation:
• Operating hours are (and will continue to be) from 10:00 a.m. to 7:00 p.m. Monday through Friday, with
an occasional Saturday lesson;
• Lessons last an average of 30 minutes, but can range from 25 minutes to 60 minutes;
• There will be occasional back-to-back lessons, but this is not a regular occurrence;
• Currently five (5) students are located on neighborhood, some walk to lessons.
• There are no recitals on-site.
The property (TMP 76M2-01-00-113) is located at 924 Royer Drive, in the Willoughby Village planned unit
development. Willoughby Village is located off of Fifth Street, just south of the city limits. The 0.24 acre parcel is
zoned PUD. Royer Street consists of single-family detached homes.
DISCUSSION:
The applicant is seeking a modification of Section 5.2 (e) of the Zoning Ordinance for home occupations,
which states, "[t]he traffic generated by a home occupation shall not exceed the volume that would normally
be expected by a dwelling unit in a residential neighborhood." The Zoning Department assumes the
"normal" volume of traffic for a dwelling unit is 10 vehicle trips per day and will also allow one additional trip
per day for clients, stipulating that these trips should be spread throughout the week (seven per week). No
group sessions are allowed without modification; the applicant is not requesting permission to conduct
group sessions.
Staff has evaluated the request based on the traffic impacts to Royer Drive, the Willoughy Village road
network and the neighborhood. The applicant is requesting up to 20 students per week, which would
average 5 per day (for Monday — Friday, less if there are any Saturday sessions). This results in an average
of up to 20 trips per day to the home, 10 from the residential use and 10 from the home occupation.
Planning staff typically evaluates traffic generation for this type of request against other uses permitted by
right within residences, most particularly a daycare serving up to five children (a special use permit is
required for a day serving six or more children). A by -right daycare would generate up to 20 trips per day (4
trips/day for drop-off and pick-up) in addition to the 10 trips from the residential use. The applicant's
request is consistent with (below) this level of by -right use.
The trips will occur throughout the day. The home occupation is located on a lot located on a cul-de-sac, so
there is no through traffic on this road. The driveway for the property in question is long and wide enough to
accommodate 3 to 4 cars. Therefore, adequate space exists for student drop-offs and pick-ups. Staff
observed no other unusual issues related to traffic or parking in this area.
SUMMARY:
Staff has identified the following factors favorable to this application:

The level of traffic potentially generated from this request is consistent with other by -right uses
permitted within residences (including day care for up to 5 children);
Royer Drive and the driveway serving the residents/home occupation can adequately accommodate
anticipated traffic, drop-off/pick-up, and parking activity generated by this request.
Staff has not identified any unfavorable factors.
RECOMMENDATION:
Staff recommends approval of HO 2011-142, with the following conditions:
1. Clients may only be on the property between 8:30 a.m. and 7:30 p.m.;
2. No more than 20 clients per week (Monday through Saturday);
3. No more than one client per session; no group sessions.
