RE: Variation from Application Plan for ZMA 1977 -24 - Proposed variation to road location with Clifton Lake
Subdivision as represented by SUB 2010 -00127
Dear Mr. Baldwin:
You have requested that the County provide further advisory comments as to whether a variation to the road location on
the approved application plan for the Shadwell Estates PRD can be approved. This letter is to provide guidance in
addition to that provided in Scott Clark's letter to Michael Myers of December 13, 2010. (Attached)
It was noted in Mr. Clark's letter that if this road re- location variation is to be approved it must provide suitable access
accommodations for the Milton boat landing in order to appropriately address the variation provisions of the Zoning
Ordinance. You have proposed to provide a public parking area accessed from Randolph Mill Lane and adjacent to
Route 729 to improve accommodations for those using the boat landing and the potential for improved future access to
the Rivanna River. This provision would be consistent with the conditions outlined in Mr. Clark's letter that could justify
variation under Section 8.5.5.3 c. of the Albemarle County Zoning ordinance. A special use permit for fill in the flood plain
is required and currently under review. A variation can be approved with recommendation for approval of the road re-
location by the county engineer and provided that: density and intensity of development is not increased; timing and
phasing of other development is not adversely affected; and the special use permit is approved. Please be aware that
approval of such a variation will also be subject to all other applicable approvals by the County.

Re: Variations from Application Plan for ZMA 1977 -24 dated November 23, .2010 — Advisory Comments
Dear Mr. Myers,
This letter is to provide advisory comments on the variation request that you submitted on November 23, 2010 for
the Clifton Lake planned residential development. That proposal shows the entrance road for Clifton Lake being
moved from the location shown on the original application plan to connect with Randolph Mill Lane. Under Section
8.5.5.3 of the Zoning Ordinance "The director of planning is authorized to grant a variation from provisions of an
approved plan, code or standard" for, among other things, "Minor changes to street design and street location ".
This proposed variation has been the subject of meetings and other communications between the County and
property owners at various times over the last two years. Consistently during that time; County staff has indicated
that a variation request should include accommodations for improved public access to and along the Rivanna River,
which is currently accessed from Randolph Mill Lane by a public boat launch. Such an accommodation would
support the County's Comprehensive Plan goals for greenway trails and recreational opportunities. It would also
support the resource - protection goals of the Natural Resources and Cultural Assets Plan and the Rural Areas Plan by
protecting the river and the adjacent wooded areas from more intense development.
Thus, the proposed variation could be justified under section 8.5.5.3(6)(C)(1) of the Zoning' Ordinance, which
permits the Planning Director, among other things, to "to grant a variation upon a determination that the variation:
(1) is consistent with the goals and objectives of the comprehensive plan". Absent this finding, a variation is not
possible.
