Mr. Petchel: Staff has reviewed your initial submittal for a Special Use Permit for expansion of B We have a few questions and comments which are listed below: Planning Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below. Comments on conformity with the Comprehensive Plan are provided to the Planning Commission and Board of Supervisors as part of the staff report. The Places 29 Master Plan recommends this as Urban Density Residential which has primary uses of multi - family and signle family residential. The secondary uses include retail, commercial, and office uses that support the neighborhood, live /work units, open space, and institutional uses. Retail, commercial, office and institutional uses are encouraged to locate in Centers so they are accessible to residents throughout the surrounding area, and so they benefit from co- location with other neighborhood serving businesses. This expansion of the existing daycare is in keeping with the Places 29 Master Plan in that a daycare provides services to the surrounding residents. Although the Master Plan states that this use should be in a Center, this property is immediately adjacent to property designated as a Center and therefore will be in conformance with the Master Plan. Staff has no objection to the expansion of this use. Neighborhood Model Page 1 of 6 Pedestrian Orientation and Neighborhood Friendly Streets and Paths- Accommodates walkers, bikers, and public transportation so that mobility can be a reality for the elderly, the young, and those with limited access to automobiles. Sidewalk may be provided with the proposed adjacent residential development and street. Sidewalk connection should be made to the existing sidewalk south on Worth Crossing, and across the front of the property. Transportation Networks and Interconnected Streets- Requires interconnected streets within developments and between developments so that pedestrians can walk easily to many destinations, traffic has alternative routes, and car trips are reduced in number and length. This is not applicable to this proposal. Parks and Open Space- Makes open space integral to overall design so that residents and workers can walk to a public park, experience preserved natural areas, and enjoy public gathering spaces. This is not applicable to this proposal. Mixed Uses- Contains a mixture of residential and non - residential uses so residents have convenient access to work, to services, and to entertainment. The daycare will provide service to immediately adjacent residential uses. Affordability and Mixture of Housing types- Mixes housing types and markets so that a full range of housing choices is offered within the neighborhood. No residential uses are proposed. Site Planning that respects terrain- Adapts development to site terrain so that natural topography can be preserved. The property is a relatively level site, so no extensive grading will need to be done. Clear boundaries with the Rural Areas- Maintains a clear boundary between Development Areas and Rural Areas. This is not applicable to this proposal. Buildings and Spaces of Human Scale- Keeps buildings and spaces at a human scale so that street views are attractive and pedestrian friendly. The addition will match the existing building. Relegated Parking- Moves off - street parking out of sight and encourages on- street parking. Neighborhood Centers- Provides for neighborhoods to have a designated center to bring diverse and continuous activity to a neighborhood. This is not applicable to this proposal. Redevelopment- Emphasizes re -use of sites. Incorporates varying densities and gradually allows for an overall increase in density in the Development Areas to meet the goals of the Comprehensive Plan. This is not applicable to this proposal. More detailed comments may be provided after more detailed plans are provided. Zoning The following comments related to Zoning have been provided by Sarah Baldwin: The proposed application and parking shown on the submitted plan are acceptable. Current Development The following comments regarding your proposal's ability to meet site plan or subdivision ordinance requirements in the future have been provided by Bill Fritz: A site plan amendment will be required. It is my understanding that the modified street shown on the submitted information may not occur. The applicant should determine how much parking is or will be available and determine what the maximum number of children the facility will accomodate. Utilities are located at the rear of the site and may need to be relocated. This information is provided only as a general comment at this time so that the applicant will be aware of the situation. Engineering and Water Resources The following comments related to engineering and water resources have been provided by Glenn Brooks: 1. It is recommended that a traffic study be provided to examine the possibility of turn lanes requirements on Worth Crossing. 2. Private road authorization and a 50' private road easements or right -of -way appears necessary from the new public road to the east property line. 3. A stormwater management plan concept should be included with the concept plan. VDOT Page 3 of 6 Revised 4 -25 -11 eke The following comments related to VDOT have been provided by Joel DeNunzio: 1. The increase in traffic for this expansion according to ITE code is 238 vehicles per day with 37 occurring in the peak hour. This increase will likely meet the threshold for a taper lane on Worth Crossing according to the analysis conducted with the Estes Park Traffic Study. 2. Entrances will need to be designed in accordance with the minimum VDOT standards. The scale of the attached drawing appears to be incorrect so it is difficult to determine the dimensions for the entrances to the proposed state maintained road. The road will be classified as an urban local and the entrances will need to meet the requirements of the VDOT Road Design Manual, Appendix F. The entrances will need to have adequate spacing, setbacks, radii, width and appropriate throat lengths. Fire /Rescue This must comply with the Virginia Statewide Fire Prevention Code. Final approval is subject to field inspection and verification. ACSA The following comments related to ACSA have been provided by Alex Morrison: 1. Site is in jurisdictional area for water and sewer. 2. Closest waterline is located on property. 3. Closest sewer line is on property. 4. Capacity issues for sewer that may affect this proposal: None Known 5. Requires Rivanna Water and Sewer Authority capacity certification: No 6. Water flow or pressure issues that may affect this proposal: None Known 7. Red flags" regarding service provision (Use attachments if necessary): Exhibit B shows impact on multiple waterlines, a fire hydrant, and a sewer line. Expansion may also require a meter size increase. ACSA require site plans to be submitted for review. Provide ACSA with existing and proposed fixture counts so that meter size can be verified. RWSA The following comments related to RWSA have been provided by Victoria Fort: 1. Capacity issues for sewer that may affect this proposal None Known 2. Requires Rivanna Water and Sewer Authority capacity certification Yes X No 3. Water flow or pressure issues that may affect this proposal None Known 4. These conditions will address: • Intensity of the activity on -site: o Maimum enrollment; o Hours of operation • Right of periodic fire official review of premises. • Safe public road access to the site including VDOT and engineering approval. • Setbacks and buffers. Action after Receipt of Comments After you have read this letter, please take one of the actions identified on "Action After Receipt of Comment Letter" which is attached. Resubmittal If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal. The resubmittal date schedule is provided for your convenience. Notification and Advertisement Fees Recently, the Board of Supervisors amended the zoning ordinance to require that applicants pay for the notification costs for public hearings. Prior to scheduling a public hearing with the Planning Commission, payment of the following fees is needed: $167.60 Cost for newspaper advertisement $202.82 Cost for notification of adjoining owners (minimum $200 + actual postage /$1 per owner after 50 adjoining owners) $370.42 Total amount due prior to Planning Commission public hearing Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the Board hearing needed. $167.60 Additional amount due prior to Board of Supervisors public hearing $538.02 Total amount for all notifications Fees may be paid in advance. Payment for both the Planning Commission and Board of Supervisors public hearings may be paid at the same time. Additional notification fees will not be required unless a deferral takes place and adjoining owners need to be notified of a new date. The full resubmittal schedule may be found at www.albemarle.org in the "forms" section at the Community Development page. Be sure to include the resubmittal form on the last page of your comment letter with your submittal. The application fee which you paid covers staff review of the initial submittal and one resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.) (2) Request Indefinite Deferral If you plan to resubmit after 30 days from the date of the comment letter, you need to request an indefinite deferral. Please provide a written request and state your justification for requesting the deferral. (Indefinite deferral means that you intend to resubmit /request a public hearing be set with the Planning Commission after the 30 day period.) (3) Request Planning Commission Public Hearing Date be Set At this time, you may schedule a public hearing with the Planning Commission. However, we do not advise that you go directly to public hearing if staff has identified issues in need of resolution that can be addressed with a resubmittal. After outstanding issues have been resolved and /or when you are ready to request a public hearing, staff will set your public hearing date for the Planning Commission in accordance with Page I of 6 Revised 4 -25 -11 eke the Planning Commission's published schedule and as mutually agreed by you and the County. The staff report and recommendation will be based on the latest information provided by you with your initial submittal or resubmittal: Please remember that all resubmittals must be made on or before a resubmittal date. By no later than twenty -one (21) days before the Planning Commission's public hearing, a newspaper advertisement fee and an adjoining owner notification fee must be paid. (See attached Fee Schedule) Your comment letter will contain the actual fees you need to pay. Payment for an additional newspaper advertisement is also required twenty -two (22) days prior to the Board of Supervisors public hearing. These dates are provided on the attached Legal Ad Payments for Public Hearings form. Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning Commission's public hearing will be allowed during the life of the application. The only exception to this rule will be extraordinary circumstances, such as a major change in the project proposal by the applicant or more issues identified by staff that have not previously been brought to the applicant's attention. As always, an applicant may request deferral at the Planning Commission meeting. (4) Withdraw Your Application If at any time you wish to withdraw your application, please provide your request in writing. Failure to Respond If we have not received a response from you within 30 days, we will contact you again. At that time, you will be given 10 days to do one of the following: a) request withdrawal of your application, b) request deferral of your application to a specific Planning Commission date as mutually agreed to with staff, or c) request indefinite deferral and state your justification for requesting the deferral. Virginia State Code requires that notice for public hearings be made by publishing a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees for public notice are required before a Zoning Map Amendment may be heard by the Board of Supervisors.
