NOTICE TO COMPLY
Dear Mr. Wood:
An Erosion and Sediment Control Inspection was made on September 1, 2011 and it was found
that portions of this site were not permanently stabilized. Under Section 17-213 of the Albemarle
County Code, this is your NOTICE TO COMPLY. Article 11, section 17 -207 requires
permanent vegetation to be installed on all denuded areas within nine (9) months after the
date the land disturbing activity commenced. County records indicate your project is
now beyond this time frame.
In order to meet the ordinance and standards, your project needs to establish permanent
non- erosive cover or permanent vegetation on all areas of the site. Any rills, gulleys,
or stockpiles should be graded smooth. Any debris should be removed. All exposed
earth should be covered with a minimum of four (4) inches of compacted topsoil if not
already present, and aggressively applied with fertilizer, seed and mulch, stone, sod or
other permanent stabilization. Refer to section 3.32 of the Virginia Erosion and Sediment
Control Handbook for permanent seeding. All slopes must be flatter than 2:1, and any
such slopes should be sodded, matted and hardwood mulched or otherwise landscaped
where seeding alone will not suffice.
Please provide drop inlet protection in accordance with the VESCH third edition dated
1992.
Please note a sinkhole is developing behind the stairwell leading into the property from
Area B and requires repair.
Please remove diversions on lot in front of Kohls as part of the permanent seeding
operation in accordance with MS -18.
Please ensure sediment basin behind stockpile is functioning properly.

Please repair sediment basin in front of Willow Glen. All slopes shall be stabilized and in
accordance with the approved E &S plan.
Unless subsequently amended in writing by this office, it is expected that permanent seeding and
related measures be in place no later than Sep 14, 2011. A re- inspection fee of $250.00 will be sent
to the owner for each re- inspection of this notice.
Under Sections 17 -213, 214 and 215 of the Albemarle County Code, failure to make these corrections by
the required date may have one or more the following results:
• You may be issued additional Notices to Comply. A re- inspection fee of $250.00 will be charged for
each subsequent Notice to Comply with re- inspection.
• Your permit may be revoked.
• You may be required to submit a new Erosion and Sediment Control Plan and have it approved before
additional land disturbance will be allowed. Review of a new plan can take up to 45 days for each
submission and it is not unusual for several submissions before the plan can be approved. This
requirement would include a new application, fee and bond for the work proposed under the plan.
• The County may issue a STOP WORK ORDER and seek relief in the Circuit Court. The Circuit
Court can fine the property owner up to $2,000 per violation, convict the property owner of a Class I
misdemeanor and require the property owner to pay any damages resulting from a failure to comply
with this notice.
Should you have a legitimate reason you can not complete the corrective measures by the above given
date, you must immediately contact me at (434) 296 -5832, or Ray Lilly at (434) 989 -1534. Unless you
have contacted us and alternative arrangements have been agreed to in writing, we will expect the
corrections to be completed by the above date.
