Dear Mr. Carollo:
In response to your Application for Letter of Zoning Compliance dated December 28,
2012, please be advised as follows:
The Property lies within the boundaries of the County of Albemarle, Virginia
and the undersigned is authorized and empowered to execute this letter on
behalf of the County.
The Property is zoned Neighborhood Model Development ("NMD"), and is
subject to ZMA2002-2 dated August 5, 2003 and a Code of Development
("COD"), dated June 10, 2003. The current use of the building (residential
and commercial office units) is permitted under the requirements of the ZMA
and COD. The residential units are permitted to be rented.
■ To the best of my knowledge, the current uses, occupancy, operation and
improvements of the Property are in full compliance with all applicable zoning
codes, subdivision ordinances, platting or building or zoning requirements.
The Property has 56 permanent certificates of occupancy for the residential
units. No certificates of occupancy exist for the unfinished commercial
spaces. The shell building is subject to a temporary certificate of occupancy
pending completion of the building.
The Property meets all access and parking requirements required by the
Albemarle County zoning ordinance and is in compliance with the current
zoning ordinance of Albemarle County, including all provisions regulating
setbacks, density and height. There are no restrictions to assigning parking
spaces.
■ No roads are complete or accepted for public maintenance. The developer is
responsible for completion and acceptance of the roads. All roads are
bonded, including Livingston Drive.
■ The current development was originally built under a site plan, SDP2006-50
approved February 16, 2007 and subject to a subdivision plat, SUB2006-191,
dated December 28, 2006. To my knowledge, there are no subsequent
amendments to the plans.
The SWM facility directly behind the condominiums is a regional facility used
by the all the properties within the drainage area. Private contractors are in
the process of converting the pond to the SWM facility, which still requires
stabilization and plantings. A bond in the amount of $98,300 is currently held
by the County subject to completion of the outstanding items. Although the
SWM is dedicated to the County, construction and maintenance is currently
held under a private agreement with surrounding landowners until the County
accepts the SWM. A Notice to Comply was issued June 18, 2007 for a lack
of drop inlet protections. If further information is required, please contact Ray
