BACKGROUND: On April 19, 2011, the Commission deferred the public hearing on this zoning text amendment so
staff could provide further information on a) the use of the document in lieu of a certified engineer's report (CER) and
b) the reasoning and impact behind the proposed revisions to the vibration standards. The Commission specifically
wanted to have the County Engineer at the deferred public hearing to be able to provide this information and to
respond to questions.
The draft ordinance has been revised as discussed on April 19th to incorporate the minor revision of omitting the
Zoning Administrator from the County Engineer's decision to allow a document in lieu of a certified engineer's report.
This revision will simply codify the current practice and remove one unnecessary step from the process created by the
prior draft ordinance.
DISCUSSION: The County Engineer will be present and will provide information about how frequently and under
which circumstances a document in lieu of a CER is accepted. This document addressing the performance standards
in lieu of a CER is not limited to home occupation uses. While this document is not a full -blown certified engineer's
report, it must adequately address all applicable performance standards.
The prior draft ordinance proposed changes to the vibration standards which included increasing the allowable
maximum vibration levels. The County Engineer suggested that prior to moving forward with this amendment, it
would be advisable to take various vibration readings throughout the community. This is a similar approach to what
staff undertook prior to revising the noise ordinance and allows comparison of the proposed standards to current
actual levels in various situations within our community. However, we do not currently have either the expertise or
equipment to conduct vibration measurement. Therefore, staff suggests instead that we maintain the current vibration
standards and instead clarify applicable terms within the new ordinance.
RECOMMENDATIONS: Adoption of the draft performance standards ordinance amendment (Attachment B).
