Dear Valerie,
On October 5, 2011, the Albemarle County Board of Supervisors took action on SP 4201100004 to allow
a one hundred and fifty five (155) feet seven (7) inches tall tower with six flush mounted antennas and
associated ground equipment within an existing non - conforming electric power tower on TMP 05800 -00-
00 -06600 in the Samuel Miller District. This special use permit was approved based on the following
conditions:
1. The monopole shall not exceed one hundred fifty -five (155) feet seven (7) inches at a ground
elevation of 649.0 + /- feet;
2. The monopole, antenna, ground equipment and landscaping shall be constructed and installed in
general accord with the plans entitled " Eagleburger Property CV352 Meriwether Lewis
Elementary School 1450 Owensville Road Charlottesville, VA 22901 with an Engineer's seal and
revised. zoning drawings dated 4/12/2011 "; and
3. Landscaping to screen the base of the tower shall be provided to reasonably screen the visual
impacts of the tower if such screening is reasonably possible on the subject property. The
screening proposal shall be subject to approval of the site plan agent and installed as a condition
of the plan for the wireless facility.
Please be advised that although the Albemarle County Board of Supervisors took action on the
project noted above, no uses on the property asp approved .-above may lawfully begin until all
applicable approvals have been received and conditions have been met. This includes:
compliance with conditions of the SPECIAL USE PERMIT;
approval of and compliance with a SITE PLAN amendment; and
approval of a ZONING COMPLIANCE CLEARANCE.
In the event that the use, structure or activity for which this special use permit is issued is not commenced
within twenty -four (24) months from the date of Board approval, it shall be deemed abandoned and the
permit terminated. The term "commenced" means "construction of any structure necessary to the use of
the permit."

Dear Valerie,
The Albemarle County Planning Commission, at its meeting on July 26, 2011, approved the above noted
petition by a vote of 6:0 with a modification to section 5.1.40 (d)(6).
Please note that this approval is subject to the following conditions:
1. The monopole shall not be increased in height.
2. The current owner and any subsequent owners shall submit a report to the Zoning Administrator
once (1) per year, by no later than July 1 of that year. The report shall identify each user of the
tower and that each user is a personal wireless communications service provider;
3. The facility shall be disassembled and removed from the site within ninety (90) days of the date its
use for personal wireless communications services purposes is discontinued.
4. All work shall be done in general accord with what is described in the applicant's request and site
construction plans, entitled "Ragleburger Property M52 Meriwether Lewis Elementary
School 1450 Owensville Road Charlottesville, VA 22901 with an Engineer's seal and revised
zoning drawings dated 4/12/2011 "
