SUBJECT: Wickham Pond - Variation to relocate affordable dwelling units

The applicant is requesting a variation from the approved plan to move the location of two (2) of
fourteen. (14) required affordable dwelling units stipulated in Proffer #2 of the approved zoning.
(See attachment) The applicant is justifying the change as providing larger units with more
available parking in the new location. Ron White, Housing Director for the County, and Tammi
Nagel, President of the Wickham Pond Community Association, both support this change.
The variation may be approved as stipulated in Section 8.5.5.3 of the Zoning Ordinance which
allows the director of planning to grant "changes to the arrangement of buildings and uses shown
on the plan, provided that the major elements shown on the plan and their relationships remain the
same" upon determination that:
1) The variation is consistent with the goals and objectives of the comprehensive plan.
The variation will allow the same number of affordable dwelling units consistent with the
Affordable Housing Policy of the Comprehensive Plan.
2) The variation does not increase the approved development density or intensity of
development.
The variation would not increase the approved density or intensity of the development.
3) The variation does not adversely affect the timing and phasing of development of any
other development in the zoning district.

Rebecca asked that we send you the attached APPLICATION FOR VARIANCES FROM
APPROVED PLANS, CODES AND STANDARDS OF DEVELOPMENT.
The request is to move the location of 2 of 14 required affordable units. All of the
affordable units at Wickhain Pond are the first floor of 3 story townhouses. 6 have been
built and occupied, 7 more are under construction. The move to the new location is
essentially the same arrangement in that it is a one story apartment under a 2 story town
house. The total number of units is unchanged. Every one who has been asked their opinion
of this move has agreed that it is appropriate. The reasons mentioned are; more parking in
the new location, larger units and no change in total units. Ron White is in favor of the
change, homeowners like it, as developer I approve of the change.
I assume you can open the attached. It would be my pleasure to drive around Crozet to
experience several of the Neighborhood developments that have been built over the last 12
years. In my experience, we all should be very proud of this model and how much positive
impact we have made to so many families. Let make this tour next week and have lunch in
Crozet.

In accordance with § 8.5.5.3 c) of the Zoning Ordinance, in order to grant the variation, the Planning :Director must
make positive findings under 5 criteria. Please provide .information about these criteria for the :Director's

§ 8.5.5.3 VARIATIONS FROM. APPROVED PLANS, CODES, AND STANDARDS OF DEVELOPMENT
The director of planning and community development may allow a site plan or subdivision plat for a planned
development to vary from an approved application plan, standard of development and, also, in the case of a
neighborhood model district, a general development plan or code of development, as provided herein:
a. The director is authorized to grant a variation from the following provisions of an approved plan, code or
standard:
I. Minor variations to yard requirements, maximum structure heights and minimum lot sizes;
2. Changes to the arrangement of buildings.and uses shown on the plan, provided that the major elements
shown on the plan and their relationships remain the same;
3. Changes to phasing plans;
4. Minor changes to landscape or architectural standards; and
5. Minor variations to street design.
d. Any variation not expressly provided for herein may be accomplished by rezoning.

Hope things are going well for you. This is to give you a head's up and chance to comment on a variation I have been
asked to approve regarding the. location of two affordable units in Wickham Pond. The attached describes the request
with supporting information. It appears from-Vito Cetta's e -mail that you are aware of this, but want to verify that this is
OK from an affordable housing perspective. I am prepared to approve the request unless you have a concern, so if you
could get back to me to confirm I would greatly appreciate it.
