SDP-2011-082 PC: February 14, 2012 Staff Report p. 0 STAFF PERSON: PLANNING COMMISSION: AGENDA TITLE: APPLICANT: PROPERTY OWNER(S): Joanne Tu Purtsezova - Planner; Phil Custer - Engineer February 14, 2012 SDP201 1 00082 - Boar's Head Sports Club (squash club expansion) - Major University of Virginia Foundation (c /o Chris Schooley) University of Virginia Host Properties, Inc. (c /o Chris Schooley) APPLICANT'S PROPOSAL: Request for a major site plan amendment to expand the squash club at the existing Boar's Head Inn & Sports Club. The 33' -11" high, 32,388 SF squash club will be an attached addition in front of the existing 40' high, 154,431 SF racquet club in what is currently the parking lot. The proposed parking lot, which will be moved closer to the golf course, will be re- configured and elongated to consist of 76 parking spaces replacing the 76 parking spaces to be removed. A separate employee parking lot with 34 spaces is also proposed. A critical slopes waiver request has been administratively approved in accordance with Section 4.2.3.2 of the Zoning Ordinance, which restricts earth - disturbing activity on critical slopes. A 20' buffer zone waiver request has also been administratively approved in accordance with Section 21.7. Both of these waivers were approved prior to the January 13, 2012 Virginia Supreme Court case, Sinclair vs. County of Albemarle. COMPREHENSIVE PLAN: The Comprehensive Plan designates this property as Institutional and Office Service in Neighborhood 6. SELECTED PLANNING AND ZONING HISTORY: (See abridged history, [Attachment E]) ZMA- 2004 -015 - Boar's Head Inn and Sports Club Tennis Facilities — Approved 1210812004 Request to rezone approximately 13.4 acres from R -1, Residential to HC, Highway Commercial, to allow new indoor and outdoor tennis courts. SP- 2004 -035 - Boar's Head Inn and Sports Club Tennis Facilities Request for special use permit to allow new indoor and outdoor tennis courts at the existing Boar's Head Inn & Sports Club, in accordance with Sections 13.2.2(4), and 24.2.2(l 0) of the Zoning Ordinance which allow for swim, golf, tennis and similar athletic facilities. REASON FOR PLANNING COMMISSION REVIEW: A) This major site plan amendment has been called up by an adjacent owner. In the meeting with an adjacent property owner on December 30, 2011 as well as the Site Review Committee meeting on January 5, 2012, the adjacent property owners expressed general concerns with landscape screening and parking. The adjacent owners have since withdrawn their "request for review" letter. However, the letter from the adjacent owners was submitted after abutting owners were notified of the Planning Commission review. SDP-2011-082 PC: February 14, 2012 Staff Report p. 1 SITE PLAN AMENDMENT: This major site plan amendment was reviewed by all members of the Site Review Committee. While some outstanding issues remain, these issues can be addressed through the conditions of approval. Had the amended site plan not been called up to the Planning Commission, the relevant Site Review Committee members /agencies would have worked with the applicant to resolve any outstanding issues as is typical in an administrative review process. FACTORS FAVORABLE: 1. The general concept of the amended site plan forwards public welfare. 2. Inspections, Fire & Rescue, and E911 have no objections. 3. The applicant has been working to address landscaping and parking concerns by the adjacent owners and the "request for review" letter has been withdrawn. FACTORS UNFAVORABLE: 1. Not all site plan and zoning ordinance regulations have been met at this time. 2. This amended plan is inconsistent with the constructions plans (ACSA). 3. Field review in December 2011 and on January 24, 2011 by Staff (Planner and Engineer) show that the proposed employee parking lot may not have a safe entrance, as the 15 MPH speed limit proposed by the applicant appears to be too low. A 25 MPH average vehicular speed appears to be more reasonable. RECOMMENDATION: Staff finds that the general concept of the proposed amendment forwards public welfare, but that individual elements of the current design may not meet public safety standards. Not all site plan requirements have been met, but the remaining issues are relatively minor in nature. All of the reviewing agencies still need to work directly with the applicant to resolve these outstanding issues. Staff recommends approval with conditions. RECOMMENDED CONDITIONS: The amended site plan shall not be signed until the following conditions have been met: 1. Planning /Zoning approval. 2. Engineering approval. 3. Albemarle County Service Authority approval. 4. Virginia Department of Transportation approval. ATTACHMENTS: A. Vicinity Map B.
