Dear Mrs. Wilmer:
On January 11, 2012, the Albemarle County Board of Supervisors took action on SP #201100028 to allow
collocation of antennas and associated ground equipment on an existing tower on the above referenced
parcel in the Jack Jouett District. This special use permit was approved based on the following
conditions:
Development and use shall be in general accord with the conceptual plan titled "Commonwealth
CV646 Collocation on an Existing 100' Self- Supported Tower" prepared by James A Bumgarner,
Jr and dated 9/27/11 (hereafter "Conceptual Plan "), as determined by the Director of Planning
and the Zoning Administrator. To be in accord with the Conceptual Plan, development and use
shall reflect the following major elements within the development essential to the design of the
development, as shown on the Conceptual Plan:
a. Height
b. Mounting type
C. Antenna type
d. Number of antenna
e. Color
f. Location of ground equipment and fencing
Minor modifications to the plan which do not conflict with the elements above may be made to
ensure compliance with the Zoning Ordinance.
2. The following change must be made to the Conceptual Plan: The Conceptual Plan must be
amended to provide a light fixture which is fully shielded and meets the definition of Full Cutoff
Luminaire, "Any outdoor light fixture shielded in such a manner that all light emitted by the fixture,
either directly from the lamp or indirectly from the fixture, is projected below the horizontal plane"

as required by Chapter 18, Section 4.17.
In addition the Board also approved, by a vote of 6:0, granting modification of Sections 5.1.40(a)(4d),
(a)(4f), (a)(4g), (a)(6), (b)(2), (c)(6), (c)(7), (c)(2vi), (d)(2), (d)(6) and (d)(7) of the Zoning Ordinance.
Please be advised that although the Albemarle County Board of Supervisors took action on the
project noted above, no uses on the property as approved above may lawfully begin until all
applicable approvals have been received and conditions have been met. This includes:
• compliance with conditions of the SPECIAL USE PERMIT;
• approval of and compliance with a SITE PLAN amendment; and
• approval of a ZONING COMPLIANCE CLEARANCE.
In the event that the use, structure or activity for which this special use permit is issued is not commenced
within twenty -four (24) months from the date of Board approval, it shall be deemed abandoned and the
permit terminated. The term "commenced" means "construction of any structure necessary to the use of
the permit."
