This letter is to advise you that the Property is located within the PUD, Planned Unit Development, R-6 zoning district, as well as in the Entrance Corridor and Airport Impact Overlay districts, designated by the Zoning Ordinance of the County of Albemarle, Virginia (the "Zoning Ordinance"). The current use is permitted by right in the PUD. Abutting properties are zoned PUD, R-6 and R-10. The Four Seasons Apartment development was built under Conditional Use permit (CU) 111 (attached), which served to rezone the property on July 17, 1969 to a Planned Community with a density not exceeding 390 units in the area designated as "apartment tracts." Our records indicate that 310 dwelling units were built. Though we have a plan that shows the development (SDP -136 attached), our files are incomplete and we do not have an approved site plan. Therefore, the apartments may continue as they exist; however, any change in use or number of dwelling units would require compliance with the current Albemarle County Zoning Ordinance. No variances have been granted for the property. The apartment complex was built in the 1960s prior to Albemarle County having a building code, and no Certificates of Occupancy were issued at that time. Subsequent renovations have been done that have not required Certificates of Occupancy. In 2001 permits were issued for a swimming pool and pool equipment building but as of this date final inspections have not been requested so these applications are still active. We have no record of any unresolved building code violations or pending notices of building code violations for the property. The property was inspected for zoning compliance on June 13, 2006. No site plan violations were identified at that time.
