Ray, LS John Shepherd Albemarle County Zoning Department 401 McIntire Road Charlottesville, Virginia 22903 Dear Mr. Shepherd: Land Surveyors Land Planners May 1, 2006 We believe Parcel 81 B as shown on current Albemarle County Tax Map 57 consists of 2 parcels of record and that each of these parcels is entitled to its own development rights. The last deed of record transferring the property prior to 1980 was a deed from Arthur L and Hazel M Dorsey to Katharyn N and Stillman F Kelley II dated January 30, 1952 and recorded in Deed Book 298 at page 542 in the Albemarle Country Clerk's Office (the Dorsey deed)_ Said deed lists 5 tracts of which tracts numbered 1 (17.5 acres), 4 (20 acres), and 5 (6.7 acres) substantially make up current parcel 81 B. See the attached item "Sketch Showing Tracts Making Up TM 57 Parcel 81 B" for the location and relationship of these tracts. The portion of Tract 1 in the Dorsey deed that is now within the boundaries of current Parcel 81 B (outlined in green on the sketch) was divided from the rest of Tract 1 by a plat recorded on December 30, 1982 in Deed Book 754 at page 386. This plat added a portion of Tract 1 of approximately 2.7 acres to the adjoining Tract 4. Though no development rights were specifically transferred by this instrument, a subsequent agreement between all the relevant owners and recorded in Deed Book 3046 at page 326 with a sketch attached at pages 328 through 331 assigned this tract 1 Development Right. Tract 4 in the Dorsey Deed containing 20 acres more or less is shown on a plat recorded in Deed bOOK z4t ai page o,+ ana is oumneu in orange development rights based on its own acreage. 0 Tract 5 in the Dorsey Deed (outlined in blue) is shown on a plat recorded in Deed Book 247 at page 77, less off conveyances made prior to the Dorsey Deed which left approximately 6.7 acres conveyed in said deed. Based on this acreage, this parcel is entitled to 3 development rights. Therefore, the land currently known as Parcel 81 B on Tax Map 57 should be two parcels of record: a parcel of approximately 6.7 acres with 3 development rights (Tract 5) and a parcel of approximately 22.7 acres with 6 development rights (the combined Tract 4 and residue of Tract 1).
