SUB 2012 -17 Redbud — Boundary Line Adjustment
This plat adjusts the boundaries of two existing parcels. As a result of the boundary line adjustment one
additional lot will front on Redbud Lane. This road is an approved private street. The purpose of this
memorandum is to answer two questions that have been asked:
1. Is additional review of the private street required?
2. Is a revised private street maintenance agreement required?
No additional review of the private street is required because authorization for a private street has been
previously granted. (Reference Chapter 14, Section 306 of the Code of Albemarle.)
A revised private street maintenance agreement is not required. Boundary Line Adjustments are subject to the
provisions of Chapter 14, Section 208.1 of the Code of Albemarle. This section states what provisions of
Chapter 14 apply to Boundary Line Adjustments. The requirement for a maintenance agreement is contained in
Chapter 14, Sections 234, 235 and 317. None of these sections are applicable to Boundary Line Adjustments.
While the ordinance does not require a maintenance agreement it is strongly recommended that the applicant
revise the maintenance agreement. The action of the County to approve this plat in no way impacts any rights
that other users of the street may have.
