Main Street Charlottesville, Va. 22902 RE: SP201100026 Flatwoods Land Trust New Cingular WirelesslAT &T -CV429 -Tier III TAX MAP112, PARCEL 30G Dear Ms. Long: On March 14, 2012, the Albemarle County Board of Supervisors took action on the above referenced special use permit at the above referenced parcel in the Scottsville District. The request was for a 119 - foot metal monopole with flush -mount antennae and included a waiver of section 5.1.40(d)(6) of the Zoning Ordinance to allow a pole height 30 feet above the reference tree. This special use permit and associated waiver were approved subject to the following conditions: Development and use shall be in general accord with the conceptual plan titled "CV429" prepared by O. Warren Williams, Jr., and dated 10 -10 -11 (hereafter "Conceptual Plan "), as determined by the Director of Planning and the Zoning Administrator. To be in accord with the Conceptual Plan, development and use shall reflect the following major elements within the development essential to the design of the development, as shown on the Conceptual Plan: a) Height b) Mounting type c) Antenna type d) Number of antennae e) Distance above reference tree f) Color g) Location of ground equipment Minor modifications to the plan which do not conflict with the elements above may be made to ensure compliance with the Zoning Ordinance. 2. Entrance design and location must be approved by the Virginia Department of Transportation before construction of the access road for this use may commence. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: • compliance with conditions of the SPECIAL USE PERMIT; • approval of and compliance with a SITE PLAN; and • approval of a ZONING COMPLIANCE CLEARANCE. Page I of 2 In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenty -four (24) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
