RE: Letter of Zoning Compliance- LZC- 2012 - 00014:
TMP 061X1 -00 -00 -00200 & 061X1 -00 -2B -00200 - 061X1 -00 -2B -01200
Dear Mr. La Lone,
In response to Mr. William D Tucker's request for a Letter of Zoning Compliance, this
office has researched the request and offers the following conclusions regarding the
referenced parcels:
■ The properties are located at the southwest corner of the intersection of Rio
Road W and Four Seasons Drive.
The properties are zoned PUD, Planned Unit Development, approved by the
Board of Supervisors on April 17, 1969 (ZMP -048 and ZMP -051) as a
Planned Community. This area was designated as a commercial area within
the Planned Community. There is a special use permit for a veterinary
hospital on TMP 061X1 -00 -00 -00200 approved in March of 1974 (SP -322).
There are two variances pertaining to signage for these properties (VA -1988-
093 & VA 1990 -066).
■ The properties are in the Entrance Corridor Overlay District, and the Airport
Impact Area Overlay District.
■ There are no pending re- zonings, special use permits nor variances on the
properties.
■ There is no record of any outstanding zoning violations on the properties.

■ The properties are developed as follows:
061X1 -00 -00 -00200 —Three structures, two office buildings and a
convenience store /market with associated parking, landscaping and other
infrastructure.
061X1 -00 -2B -00200 - 061X1 -00 -2B -01200 — One structure containing 11
condominium units with associated parking, landscaping and other
infrastructure.
■ The properties were inspected for zoning compliance on May 16, 2012;
The development on TMP 061X1 -00 -2B -00200 was determined to be in
compliance with the approved site plan (SDP- 1984 -055).
The development on TMP 061X1 -00 -00 -00200 was determined to not be in
compliance with the approved site plan (SDP- 1988 -034). This property
appears to have a storage shed constructed in the southwest corner of the
parking lot that was never shown on an approved site plan nor was there an
appropriate building permit obtained from the County. There also appears to
be a new fenced in portion of the lower parking lot. The landscaped buffer
shown on the approved site plan adjacent to TMP 061X1 -00 -3A -00100 thru
061X1 -00 -3A -00480 appears to not be installed as per the approved site plan.
These site plan discrepancies may be considered a site plan violation and
must be brought into compliance.
No other permits will be required for the purchase of these properties. A site
plan amendment must be obtained to correct the addition of the structure
mentioned above but this will not be required for the purchase of the property.
Any new tenants of the offices, service providers and or convenience store
will need to obtain a Zoning Clearance before starting a business at this
location.
