This approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer submits a final site plan for all or a portion of the site within one (1) year after the date of this letter as provided in section 32.4.3.1 of Chapter 18 of the Code of the County of Albemarle, and thereafter diligently pursues approval of the final site plan. An Erosion and Sediment Control Permit may be issued after the following approvals are received: 1. Approval an Erosion and Sediment Control Plan meeting the requirements of Chapter 17 of the Code of the County of Albemarle. 2. Approval of a Stormwater Management Plan meeting the requirements of Chapter 17 of the Code. 3. Approval of all easements for facilities for stormwater management and drainage control. 4. Approval of a mitigation plan for the disturbance of Water Protection Ordinance buffers. 5. Submittal of a tree conservation checklist. The final site plan will not be considered to have been officially submitted until the following items are received: 1. A final site plan that satisfies all of the requirements of section 32.6 of Chapter 18 of the Code. 2. A fee of $1,500. Please submit seven (7) copies of the final plans to the Community Development Department. The assigned Lead Reviewer will then distribute the plans to all reviewing agencies. Once you receive the first set of comments on the final site plan, please work with each reviewer individually to satisfy their requirements. Provide proof of each reviewer's tentative approval once received. The Lead Review will notify you when it is time to submit copies for signature. The final site plan will not be approved until the following conditions are met: Planning Division Approval of: (2 Copies are required to be submitted for review) 1. A site plan meeting all the requirements of section 32.6 of Chapter 18 of the Code. [32.5.2(a)] Show the minimum setback lines and yard requirements. See section 26.5 for minimum yard requirements. No construction activity, including grading or clearing vegetation (collectively, "disturbance "), shall occur within thirty (30) feet of any district other than a commercial or industrial district. You have a 50' setback shown, which applies to structures and buildings. The 30' buffer area applies to clearing and grading. It is unclear how far the proposed clearing will be from the eastern property line. Show the 30' buffer line adjacent to all non commercial /industrial parcels. 3. [32.5.2(a)] Provide boundary dimensions. 4. [32.5.2(a)] Provide the source of the topography and source of survey. 5. [32.5.2(b)] The maximum and minimum disturbed areas on sheet 0 do not match areas listed on sheet 3. Also, minimum and maximum numbers on sheet 0 appear to be reversed. Please clarify where maximum and minimum numbers are derived from as math does not appear to add up to either number. 6. [32.5.2(b)] Clarify the proposed use. Per a determination of the County Zoning Administrator, the permitted use for this site is the cleanup of a previous industrial use. In the project description include the previous use of the site and clarify how this cleanup is related. 7. [32.5.2(c)] From discussions with the applicant it seems that some phasing is proposed with excavation of stumps to occur later. If phasing is proposed, show such on plan, and include information about stump excavation. 8. [32.5.2(f)] Amend watershed note to state that the site is located within a water supply watershed. 9. [32.5.2(1)] Provide dimensions (widths) of proposed travelways. 10. [32.5.2(j)] Are the existing water and sewer lines shown contained within easements? If so, indicate deed book and page reference as well as ownership and width of existing utility easements. 11. [32.5.2(n)] State the proposed paving material types for the travelway. 12. [32.6.2 (p)] Provide a landscape plan that complies with section 32.7.9. 13. [32.7.9.4(b)] Existing trees may be preserved in lieu of planting new plant materials in order to satisfy the landscaping and screening requirements of section 32.7.9, subject to the agent's approval. If you intend to use existing trees to satisfy any of the landscape plan requirements, please include the following: a. Areas and other features shown on landscape plan. The landscape plan shall show the trees to be preserved, the limits of clearing, the location and type of protective fencing, grade changes requiring tree wells or walls, and trenching or tunneling proposed beyond the limits of clearing. b. Conservation checklist. The applicant shall sign a conservation checklist approved by the agent to ensure that the specified trees will be protected during construction. Except as otherwise expressly approved by the agent in a particular case, the checklist shall conform to the specifications in the Virginia Erosion and Sediment Control Handbook, pages III -393 through III -413, and as hereafter amended. 14. [32.7.9.7(a)(1)] Commercial and industrial uses shall be screened from residential uses when deemed necessary. A large portion of the clearing and excavation is directly adjacent to residential units. Provide screening in areas adjacent to existing homes. Screening should be in compliance with section 32.7.9.7. 15. [32.7.9.8] The minimum required tree canopy for the site is ten percent. It appears the tree canopy requirement will be met with existing trees. Provide calculations on the final site plan to show this requirement has been met. 16. [Comment] Please distinguish between tree clearing and tree removal areas. Are you not removing the trees from site within the tree clearing area? Engineering Division Approval of: (1 Copy is required to be submitted for review) 1. An Erosion and Sediment Control Plan meeting the requirements of Chapter 17 of the Code of the County of Albemarle 2. A Stormwater Management Plan meeting the requirements of Chapter 17 of the Code. 3. All easements for facilities for stormwater management and drainage control. Albemarle County Fire & Rescue Approval. (1 Copy is required to be submitted for review) Albemarle County Service Authority Approval. (2 Copies are required to be submitted for review) Virginia Department of Transportation Approval.
