RE: Waiver of Section 14-404.A (T.M. 59-29B)
Dear Mr. Fritz:
On behalf of the property owner, Three Springs LLC, and in accordance with Section 14-404.0
of the Subdivision Ordinance, I am requesting a waiver of the strict requirement of Section 14-404.A,
that requires access to the building site from only one street, shared driveway, or alley established at
the same time of the original subdivision, and shall have no immediate access onto any other public
street. The waiver would allow access to the building sites from Beckoning Ridge Road (State Route
1609) and Old Ballard Farm Lane (State Route 1644) for the following reasons:
1. Requiring access from Beckoning Ridge Road (State Route 1609) would require extending the
public road approximately 275 feet.
2. Extending Beckoning Ridge Road would require clearing, grubbing, grading and paving.
3. There would be a substantial increase in impervious area with the extension of Beckoning Ridge
Road.
4. There would be an increase of soil erosion and storm water runoff with the extension of Beckoning
Ridge Road and longer driveways to the building areas.

Please find attached Exhibit 1 and Exhibit 2, each dated December 30, 2013.
Exhibit 1 shows Lots A, B, and C with the extension of Beckoning Ridge Road (State Route 1609).
Please note that this layout will also require lengthy driveways to the building areas.
Exhibit 2 shows Lots A, B, and C with a qualifying building area that could be accessed with short
driveways from Beckoning Ridge Road (State Route 1609) and from Old Ballard Road (State Route
1644).
I believe situations like this are the reason for allowing a waiver of Section 14-404.A and we are
looking forward to your approval of this request.
