STAFF PERSONS: Megan Yaniglos, Senior Planner PLANNING COMMISSION: July 15, 2014 AGENDA TITLE: SUB2014 -031 Martin- Two -Lot Subdivision- Private Street Request APPLICANT: Bob Coleman- Residential Surveying Services PROPERTY OWNER: Charles Martin APPLICANT'S PROPOSAL: Request for private street approval for a two lot subdivision (Attachment B). COMPREHENSIVE PLAN: The Comprehensive Plan designates this property as Rural Areas in Rural Area 4. REASON FOR PLANNING COMMISSION REVIEW: The applicant has requested a waiver to allow access for the proposed subdivision via a private street per Sections 14 -232 (A)(3) and 14 -234 of the ordinance. A two lot subdivision and associated private street can be approved administratively. However, in this case, the proposed private street crosses another property, and therefore is not considered a two lot subdivision and the private street needs approval from the Planning Commission. As shown on the proposed subdivision plat, the proposed street needed for access and frontage for newly created Parcel "H ", crosses over existing parcel "I ". There is a stream and associated buffer, as well as critical slopes that the proposed street would have to disturb if located completely within the parcel to be subdivided. Parcel "I" is a signatory on the plat, and a note has been added to the plat that states the private street access easement will be for the benefit of TMP 114 -6 and Parcel "H" only. SUMMARY: Staff recommends approval of the private street to serve TMP 114 -6 and Parcel "H" only. ATTACHMENTS: A. Vicinity Map B.
