HomeMy WebLinkAboutSP200400059 Action Letter (.-- (- COUNTY OF ALBEMARLE Department of Community Development 401 McIntire Road, Room 227 Charlottesville, Virginia 22902-4596 Phone (434) 296-5823 Fax (434) 972-4126 April 15, 2005 Ann Sutherland 1574 Brown's Gap Turnpike Charlottesville, V A 22901 RE: SP 2004-059 Toad Hollow Farm Horse Show (Signs #30): Tax Map 41, Parcel15A Dear Ms. Sutherland: On April 6, 2005, the Albemarle County Board of Supervisors took action on SP 2004-059 to allow horse show grounds, permanent, in accordance with Section 10.2.2.12 ofthe Zoning Ordinance which allows for horse show grounds, permanent in the RA (Rural Areas)by Special Use Permit, on Tax Map 41, Parcel 15A in the Whitehall Magisterial zoning district. This special use permit was approved based on the following conditions: 1. The horse show use shall be conducted in general accordance with the concept plan, titled "Toad Hollow Farm" and labeled as "Attachment B"; 2. There shall be no outdoor amplified sound system for events; 3. There shall be no overnight camping; 4. All exterior light fixtures shall be full cutoff luminaries and fully shielded and arranged or directed to reflect light away from adjoining properties and away from adjacent roads; 5. Prior to the issuance of a Zoning Clearance for the horse show use, the applicant shall provide sight distance at Cannon Brook Way and Route 680 (Browns Gap Turnpike) to the satisfaction of the Virginia Department of Transportation; 6. Subject to the approval of the County Engineer, prior to the issuance of a Zoning Clearance for the horse show use and to provide safe and convenient access to the site, the applicant shall provide a minimum of two (2) gravel pull-offs along Cannon Brook Way to allow two (2) vehicles to pass safely. The applicant shall also provide two (2) DO NOT ENTER signs and one (1) ONE WAY sign placed at locations specified by the County Engineer along Cannon Brook Way; 7. The number of horse show events shall be limited to six (6) per year. The maximum number of participants and attendees at any single event shall be eighty (80); and 8. The number of events, other than horse show events, shall be limited to four (4) per year and the maximum number of participants and attendees at any single event shall be limited to forty (40). These events shall not utilize the pastures for parking. SP 2004-059 Toad Hollow Horse Show Page 2 April 15, 2005 Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals bave been received and conditions have been met. This includes: . compliance with conditions of the SPECIAL USE PERMIT; and . approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenly-four (24) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
