HomeMy WebLinkAboutSP200400040 Action Letter F~ COUNTY OF ALBEMARLE Department of Community Development 401 McIntire Road, Room 227 Charlottesville, Virginia 22902-4596 Phone (434) 296-5823 Fax (434) 972-4126 January 18, 2005 Collier, Ken Hughes, Good, O'Leary & Ryan, Inc. 6 Executive Park Drive, Suite 300 Atlanta, GA 30329 RE: SP 2004-00040 Mount Fair Farm (Sign #73 & 95; Tax Map 26, Parcel 33 Dear Mr. Collier: On January 5, 2005, the Albemarle County Board of Supervisors took action on SP 2004-00040 to allow fill in the floodplain for the purpose of constructing two stream crossings for a second driveway/farm road, in accordance with Section 30.3.05.2.2(3) of the Zoning Ordinance, which allows for fill in the floodplain on Tax Map 26, Parcel 33 in the White Hall Magisterial zoning district. This special use permit was approved based on the following conditions, as recommended by the Planning Commission: 1. With the exception of all changes that would be required in order to comply with the conditions listed herein, the site shall be developed in general accord with the plans entitled, "Mount Fair; Albemarle County, Virginia; MacFarlane Residence; Whitehall Virginia," dated revised 11/19/04; 2. Approval and bonding of an erosion and sediment control plan; 3. Approval and bonding of a mitigation plan for buffer disturbance; 4. Federal and state agency approval for stream and wetland disturbances; and 5. FEMA approval of a map revision (LOMR or LaMA). Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: . compliance with conditions of the SPECIAL USE PERMIT; and . approval of a ZONING COMPLIANCE CLEARANCE. SP 2004-00040 Mount Fair Farm January 13, 2005 In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenty-four (24) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
