Subject: SUB 201500063 Matthew Crane TMP 31 -38K — Final Subdivision Plat
The County of Albemarle Planning Division will grant or recommend approval of the Final Plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision /Zoning Ordinances unless otherwise specified.]
1. [Comment] The application was filled out incorrectly as a Preliminary Plat, along with an incorrect fee.
This should have been submitted as a 2 -lot subdivision ($540) along with a Tier 2 groundwater assessment
($330), for a total application fee of $870. Since the application was filed as a Preliminary Plat, the
associated fee of $1150 was paid. Please pay the correct fee; once it's submitted, I will request a refund of
the original fee (this could take several weeks to process).
2. [14- 302(A)(3)] Existing or platted streets. Provide the width of State Route 743.
3. [14- 302(A)(10)] Right of further division. Remove the note regarding development rights as development
rights are not applicable to Village Residential zoned parcels.
4. [14- 302(8)(1)] General information. When revised, please include the revision date on the plat.
Additionally, please provide sheet numbers.
5. [14- 302(8)(5)] Zoning classification. Add Airport Impact Area (AIA) to the Zoning information.
6. [14- 302(8)(7)] Reservoir watershed /agricultural- forestal district. Revise the watershed note to state that
the parcel is located in a water supply watershed.
7. [14- 302(8)(8)] Yards. Provide a note listing the required yards. In Village Residential, the yards are as
follows: Front —25', Side — 15', Rear — 20'.
8. [14- 302(8)(10)] Stream buffers. Show the location of stream buffers on the property, along with the
following note, "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle
County Water Protection Ordinance ".
9. [14- 303(D) & 14 -400] Acreage of lots. Lot 1 does not meet the minimum lot size of 60,000SF required by
section 12.3. The lot shall be revised to meet the minimum standard or the subdivision cannot be approved.
10. [14 -403 & 14- 232(b)] Lot frontage. As currently proposed, the residue does not have the required frontage
on either a public or private street. This proposal meets the requirements for private street approval (2 -lot
private street) as listed in section 14- 232(b). In order to meet the frontage requirement, label the `access
easement' a `Private Street' and address all street related comments below.
11. [14- 303(N)] Statement pertaining to private streets. Provide the following statement: "The streets in this
subdivision may not meet the standards for acceptance into the secondary system of state highways and
will not be maintained by the Virginia Department of Transportation or the County of Albemarle."
12. [14- 308.1] Groundwater assessment information. As noted above, the Tier 2 groundwater assessment fee
must be paid.
13. [14 -309 & 14 -310] Soil evaluations & Health director approval of septic systems. Health Department
approval of a primary and reserve drainfield for each parcel is required. Soils evaluations must be
submitted to Community Development, and will then be forwarded to the Health Department for their review
and approval. This plat cannot be approved until their approval is granted.
14. [14 -316] Approval of entrance onto public streets. Please provide VDOT approval of the proposed private
street entrance; contact information can be provided if needed.
15. [14 -317] Instrument evidencing maintenance. If the subdivision will contain one (1) or more improvements
that are not to be maintained by the county or any authority or other public agency, the subdivider shall
submit with the final plat an instrument assuring the perpetual maintenance of the improvement. This
should include maintenance responsibilities for the proposed private street. The instrument shall be
submitted for review and approval, and must be recorded with the plat.
Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is
kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which
may be found under "Departments and Services" at Albemarle.org.
In accord with the provisions of Section 14- 229(B) of Chapter 14 of the Code if the developer fails to submit a
revised final plat to address all of the requirements within six (6) months after the date of this letter the
application shall be deemed to have been voluntarily withdrawn by the developer.
