Box 586 RuckerSville, VA 22968-0586 (434) 960-1464 arvonl04~cs.com August 6, 2002 To the Boards of Supervisors of Albemarle, Orange, and Greene Counties: At the July 3rd, 2002 meeting of the Albemarle CountY'Board of Supervisors, Mr.'Perkins stated he had read a news story in the Daily Progress~ about a $3 million grant for a regional park. It was requested that Albemarle stafflook into the matter with respect to the Preddy Creek property and report back to the Board. The thought of three million dollars is quite delicious for any reason, but especially if it could be invested in a regional park in the tri-county area that is fast being overwhelmed by new and expanding subdivisions in all three counties, the Fried Development at Rts. 29 and 607 in Greene, and the nearby burgeoning "Spy Shop" and UVa Research Park in Albemarle, among others. However, why look for $3 million from a far-away agency at some far-distant time when.the Park is already developed and has been operated for years by enterprising members of America's famous Underground Economy?. Besides Albemarle Countfs 568~acre'property, there are closer to 1,000 acres of wonderfully wooded land with trails already built and used daily by dozens if not hundreds of ATV and'horseback riders, trails which stretch fi:om Bumley Station Road in Albemarle to Bumley Road in Orange, and from Willy Miser Lane in-Orange through Anna Robertson's land in Greene in some places almost all the way to Sheetz gas station at Routes 29 and 607. Greene County recently went through a permit application process with the Crawfords of Bacon Hollow which you may have read about 'in the newspapers. These Crawfords have for years operated a famous motocross course where people Come from miles around' to ride for only $10 a day. Many persons who visited the Crawford track enthusiastically splurged overS7,000 on an ATV which they are now riding on the-Preddy Creek and adjoining properties. From the aspect of ATV's alone, if the now-existing ATV Preddy Creek Park were officially opened to the public, there would be a lot of clinking of cash registers for the three counties from the huge sales tax income from the sale of dozens more ATV's! The Preddy Creek property, as shown in its chain of title, has a 12 foot road (named for 911 purposes "Atto Road") fromthe foot of Willy Miser Lane (Rt. 613) all the way over to Burnley Road. As shown on the tax maps of Albemarle and Orange Counties, it l~)oks like a super highway, but there's not much in the court records about this road. Certain persons took -advantage of this fact to, first chase people offthe road at gun point, then erect a bogus sign (without a permit) that it was "Not a public access road" (which it really was.) Then a gate was' put up and Albemarle staff, instead of behaving consistent with the Ritter matter, actually not only agreed to the gate but also to the gate being locked and legitimate landowners kept from accessing their land starting with me. Some landowners laid low while all this was going on, but the day after this past Memorial Day, Michael Riner, a property owner and contractor whose only access is Arto Road, came in with chain saws and a bull dozer, widened the road to about 20 feet and even laid gravel. Since Albemarle never surveyed the road, there's no benchmark to measure against. I purchased my land in July 1992. I enclose an estimate I got from McWilliams that September to improve the road as it was then. Each year I travel on the road several times to preserve my legal right to use it. I have observed OVer the years that portions of the road have been moved, presumably by the Oehmkes who were trying to get the entire road on their property so they could control it. I paid for a survey and set the survey to record in both Orange and Albemarle in 1998. Enclosed I have added some other surveys and information with reference to this road because I noticed that in the Minutes of the November 5, 1995 Meeting of the Board of Supervisors the staff report stated that there was a road to the Preddy Creek property in Orange County, but no mention was made of the fact that the road actually goes over. the property. In addition to the fact that neither the Riners nor I, in our competing chains of title' (which uses the same wording in the deed) have a deeded right of way, the Riner chain of title does show a way from 607 down an old road that James McWilliams laid his driveway over. Since McWilliams and his large family have made many ATV roads and trails over what is now my land (shown in the survey as Butner), the actual road was never abandoned, so if the Park-were to be opened to the public, or a contractor bought the Riner/Pet6fi tract and Albemarle County did not want the road Widened to 50 feet, perhaps that should be the desig~ted' access for the 68 ac~s? In any case, you should be forewarned that this Riner property, on which I have a competing chain of title, is presently listed for sale -- for the benefit of the Riners ' by Century 21 Manley Associates as their #340024, "with subdivision rights." Attached are some of their recent ads for you to read. There is more information on their web site: It would be a terrible shame if some contractor snapped up this property (which as you may see by the enclosed plat is bracketed in Albemarle by the Preddy Creek property) and popped in a subdivision while Albemarle was waiting to hear the report about the $3 million. Therefore, by this letter, I implore each and every one of you, each individual member of the Board of Supervisors of the three involved counties, to jump into your cars (or get Pat Mullaney to chauffeur you) to drive down this nice new gravel road over the Preddy Creek property to see what a fine, beautiful park this could be, and what lovely roads and trails (and even bridges) already, exist, ready to be used by the Public and not just the Crawfords, Oehmkes, and McWilliamses. Because the possibilities of the beautiful watershed Preddy Creek property have been on the back burner for the over 30 years since Albemarle County bought the land from Charlie Hurt, I am enclosing a pot pourri of documents for your information. 2 These include a compiled survey plat showing Albemarle's survey of the 568-acre Preddy Creek property which lies in the three counties and in Greene adjoins Mrs. Robertson's land which Greene County wanted to use as a sewage treatment plant for the Fried development. This compiled plat was made at Mint Printing, accurately reduced and matched to scale, comprising the two plats Albemarle had done of its property, plus a plat of my property. I also enclose a full- size copy of my own plat. In particular, these plats shoTM my access to my land, part of which access is the road which lies across the outer edge ofAlbemarle's Preddy Creek property in Orange, which 12-foot access.is shown in Albemarle's chains of title as filed in the Circuit Courts in both Albemarle and Orange Counties but which was not indicated on. their survey plat when it was done. This is the road recently improved by the Riners which I invite you to drive on to inspect the Preddy Creek property and its profitable possibilities. I also enclose a two-page report to Albemarle's Board of Supervisors given years ago which is very current as it is talking about a drought and exhorting action, Minutes from the Orange County Planning Commission meetings in 1985 and 1987 when they effectively closed an access from Burnley Road without implementing the planned relocation of th~ road. This relocation ought to be implemented before the 20 years is up or it will be lost, right at a time when it would be needed because of the tem~ble traffic on 33. Because certain persons have for years been attempting to deny me access to my 23.88 acres by my original, actual access, I enclose a copy of a news story about the situation where Albemarle County took the Ritters to court because (in just the converse of the problem I have had), they put a gate up and tried to block an old road. Fred Payne, accordin~to the case file in the Ritter matter, charged the Ritters about $25,000 and lost the case, so Albemarle is'acting in an inconsistent manner by putting gates up and trying to keep people from enjoying the Preddy Creek property, which, in fact, only keeps the law-abiding citizens away. Other kems are self-evident. In short, before any more nearby or adjoining properties are turned into subdivisions, and before any more private propert~ owners lay their driveways down ove£~mbtic roadways and put gates up or get out their guns, I believe that Mr. Perkins' suggestion should be acted on and the Preddy Creek property, with or without the $3 million benefit, should be opened to the use of the taxpayers as an akeady developed horse and ATV park. I also believe that, in a spirit of fairness and decency and good-will, that the matter of the access shown on the tax maps and in the deed bookS (or not shown) should be resolved once and for all, clearly and openly for the Riner/Pet6fi and the 23.88-acre Pet6fi property, and that Albemarle should set a consistent policy with regard to access roads - either prevent them from being closed as they did with the Ritters, or allow them to be closed but to make and implement a fair substitute when they are closed, as Orange County meant to do and I hope will, now they've been reminded. To that end, I herewith make a formal offer: as you may see on looking at my plat, the ,original" road which goes across Albemarle County's Preddy Creek property and Which, in the deeds, is only 12 feet wide, could be "closed" (as was the case in Orange with the S-B Road at the other end of this road), but a new, wider (50 feet for modem requirements) road could be mn parallel over the adjoining property of which I am a part-owner. This in some areas would only require moving the road about 40 feet (to give 20 feet off?the line to each side.) That way the Preddy Creek property and the Oehmkes could have the old 12 foot road, but at the same time, whoever ends up with the now Riner/Pet6fi 68+ acres plus the lower access to my 23.88 acre parcel (which needs the lower access because of a creek) could have a larger, safer road which fire trucks and emergency vehicles could travel on. Or maybe the entire road could be relocated to the boundary line because with all the drought, there is high danger of fire and there really should be a wider road to protect all the properties.~ This might sound like gobbledegook, if you are sitting in a building reading this, but if you would only get out on the land you could understand at once what I am trying to convey. According to what I read on the VDOT site on the InterNet,~moving a road is in the bailiwick of the Board of Supervisors. -While such niceties do not fret the Oehmkes, Crawfords, or McWilliamses in their own economy, where they just do what they want and get away with it, it has been a real hindrance in communication about these matters for a law-abiding citizen like me over the years. The road I am talking about (the 12-foot road shown in the Court records) is in Orange, within the territory of the Orange County Board of Supervisors, but it runs over land (in Orange) belonging to the Board of Supervisors of Albemarle County and accesses properties lying in both Orange and Albemarle, so even though it is easily dealt with on the physical plane with Chain-saws, bulldozers, and four-wheelers, it's a rather daunting ta~s~,within the bureaucracy: .But whatever is done, decisions should be made by the Boards of Supervisors for the good of the whole and not by guns, gates, grading, and gravel for the good.of the greedy. Again, I would invite all the members of each of the Boards of'Supervisors to drive down the nice new gravel road the Riners fixed up - which goes over Albemarle's land - so you can see what a lovely park it could be, and how much the ATV riders have been using the trails, woodland, and creek. You can walk or ride for.miles in any direction, including onto my property with my welcome. Please come and see. The ATV riders have made nice bridges, so you can even cross the creek in several places. The Preddy Creek property would be perfect for a regional park. Please make it a proper park NOW! Shenandoah National Park offi- cials say they do not want an ira- portant public route into the park closed. There are only two hiking routes into the park from Albemarle County -- Brown's Gap and Sugar Hollow. The road through Ripper's prop- erty is the only way hikers can reach two of the most beautiful waterfalls in the southern half' of the park ~ the James River Falls and the Doy!es River Falls -- with- out driv/ng onto the Skyline Drive, said park Superintendent William Wade. The attempt to close the road is part of a larger problem: an in- creasing number of' landowners along the boundaries of the park are dosing public entrances, he said. Among other problems, the trend is making it difficuIt for hikers to walk from the crest of the Blue Ridge into the counties below, Wade said. Hikers say they want the road left open for a simpler reasoni it is one of the most beautiful three- mile waIks in Central Virginia. The road took on military signifi- cance during the Civil War. In the late spring of 1862, Stonewall Jackson an.d his soldiers briefly oc-~ cupied the western, fringes of bemarle County, including Brown's Gap. The troops traveled over the Blue ' Ridge using Brown's Gap Turnpike as they maneuvered to outsmart, Union forces during the Shenam' doah Valley Campaign. Jackson's. 17,000 troops were victorious in this campaign, defeating 60,000 Union troops with a series of raids,,. rapid maneuvers and surprise tacks. PRESENTLY~ THE TOWN HAS OUTGROWN ITS ANTIQUATED SYSTEM~ HOWEVER~ THE ENTIRE COST OF THIS PROJECT MUST BE BORNE BY THE COUNTY. ~ECAUSE OF ITS PRIXIMITY TO THE JAMES ~IVER~ THERE IS NOT ENOUGH ECONOMIC JUSTIFICATION TO SPONSOR A PRO~ECT WITH SMALL ~ATERSHED FUNDS (PL-566), BECAUSE OF ITS PROXIMITY TO THE RIVANNA ~IVER THIS HOL~ TRUE ON THE SiTE AT [ARLYSVILLE ALSO. STOCKTON CREEK - THIS WATERSHED IS LOCATED IN THE WESTERN PART OF ALBEMARLE COUNTY AND DRAINS THE SOUTH--EASTERN SLOPE OF THE BLUE ~IDGE TO ROCKFISH GAP. THIS IS VERY FINE SOURCE OF WATER THAT BLENDS ITSELF NICELY IN WITH THE PRESENT ~EAVER CREEK WATERSHED AND INDUSTRIAL DEVELOPMENT THAT IS TAKING PLACE IN THAT AREA.' A 1~0 ACRE LAKE PROVIDING ~.227 ACRE FEET OF WATER (1~©~8,?75.©0© GALS.) COULD BE CONSTRUCTED HERE. THiS PROJECT COULD CONCEIVEABLE qUALIFY FOR FOR PL-5~ FUNDS. Two PROBLEMS WILL HAVE TO BE RESOLVED IN THIS WATERSHED. THE COUNTY WILL HAVE TO GET THE COOPERATION OF THE HIGHWAY DEPARTMENT CONCERNING THE DESIGN OF ~OUTE #~ WHICH IS SCHEDULED TO CROSS IN OR VERY NEARBY THE PRO- POSED SITE. The Board of Supervisors discussed these changes at its monthly transportation worksession. The changes were related to budget issues at the State level. VDOT has submitted a handout identifying these changes (Attachment A). DISCUSSION: The changes in the funding did not impact the priorities of the projects approved by the Board of Supervisors on January 16, 2002 (Attachments B & C with revised dates), but the revisions did impact the total number of projects in VDOT Secondary System Construction Program and the estimated advertisement dates for projects in VDOT's Plan. The Board of Supervisors are not required to hold another public hearing, but VDOT is requiring the County to indicate its awareness that the allocations have been reduced and estimated advertisement dates adjusted for the FY 2002/03 thru FY 2007/08 Secondary System Construction Program. Approval of two special use permits is required before approval of the preliminary site plan can be granted. One SP is for the allowance of motor vehicle sales and rental in the urban area as designated in the Comprehensive Plan, and the other is for the allowance of outdoor storage and display within an Entrance Corridor. In this case, the designated Entrance Corridor is Route 250. Petition: Request for preliminary site plan approval, contingent upon the approval of two (2) special use permits. A permit must be obtained for the operation of a vehicle rental facility, in accordance with Section 22.2.2(8) of the Zoning Ordinance, which allows for motor vehicle sales and rental in communities and the urban area as designated in the Comprehensive Plan. Allowance of outdoor storage and display of vehicles in an Entrance Corridor also requires a permit in accordance with Section 30.6.3.2(b) of the Zoning Ordinance, which allows for outdoor storage, display and/or sales serving or associated with permitted uses, any portion of which would be visible from an Entrance Corridor street. The property, described as Tax Map 78 Parcel 17A, contains 2.478 acres, and is located in the Rivanna Magisterial District on Newhouse Drive just off of Route 250 by the Rivanna River. The property is zoned C-1, Commercial, and is within a County Entrance Corridor [Rt. 250]. The Comprehensive Plan designates this property as Community Service in Neighborhood 3 of the Development Area. Character of the Area: Parcel 17A is currently a vacant lot adjacent to the Rivanna River and the Pantops Shopping Center. Construction of the Riverbend Garden Apartments, which occupied the same parcel of land as this site until recently, has commenced just south of this site's location. Most of the areas to the west of the site are wooded along the Rivanna River, whereas the area directly east of the site is the rear of Pantops Shopping Center. RECOMMENDATION: Staff has reviewed the proposal for conformity with the Comprehensive Plan and with Zoning Ordinance Sections 31.2.4.1, 22.2.2(8) and 30.6.3.2(b) and recommends approval of both special use permits (SP-02-10 & SP-02-11) with conditions, and approval of the preliminary site plan (SDP- 02-22). Planning and Zoning History: Development activity on Parcel 17A has largely been associated with the Riverbend Garden Apartments. These rental apartments were allowed in the C-1 district under a special use permit (SP-1999-44), which was approved with conditions. On January 31, 2001, the final site plan (SDP- 2000-97) for the apartments was approved. A recent subdivision (SUB-2002-57) has been approved in April of this year that separates the property with the apartments from the 2.478 acre subject to these permits. This subdivision also created a parcel which will be dedicated to the County for Greenway use and a second out- parcel. SPECIAL USE PERMITS Comprehensive Plan and The Neighborhood Model: Requests for special use permits in the Development Areas are assessed for conformity with the Neighborhood Model and the Land Use Plan. With the large number of car-oriented businesses located in Neighborhood 3 (Pantops), the proposed vehicle rental facility would not be a significant departure from the current land-use and character of the area. However, the Comprehensive Plan does recommend that the area designated for Community Service behind the Pantops Shopping Center (the specific location of this site) be explored for river oriented development, which this proposal does not facilitate. Though the proposal does not meet this request, there are always future opportunities for the site's redevelopment as a more river-oriented use. That aside, the proposal does further the intentions of the Comprehensive Plan by aiding with infill development efforts in the Development Areas and adding a use that would be oriented to and served by an existing internal network, which does not intensify the strip development found in the Pantops area. Given these considerations with the aforementioned land use and character of the Pantops area, this use could be supported at that location. An assessment of the proposed project as it relates to the twelve principles for development in the Neighborhood Model are provided below: Pedestrian Orientation - A 4'-6" sidewalk will extend from the proposed building to the shared boundary with the Shell station. Neighborhood Friendly Streets and Paths - No new streets are proposed with this development. It will be accessed from an existing road network. Interconnected Streets and Transportation Networks - Given the infill nature of this project it is already well connected to existing street networks. Connections emanating from this parcel would not be recommended due to the greenway parcel which surrounds it and critical slopes and flood plain associated with the Rivanna River. Parks and Open Space - Not applicable, however, it should be noted that the subdivision plat which created the subject parcel also created a parcel which will be dedicated to the County for greenway use. The greenway is located adjacent to this site. Neighborhood Center - This property is located in a shopping center. Buildings and Spaces of Human Scale - The proposed building is relatively small (< 3,000 sq. ft.) and about 2 stories tall. The mass of the building will only use 2.57% of the overall site and is compatible with other, detached, buildings in the shopping center. Conditions of approval below will help to screen this use from the Entrance Corridor. Relegated Parking - Parking is proposed and will appear to be behind the existing shopping center building. Parking will be blocked from view from Route 250 by the proposed building, the existing Shell station, the existing Hardees building and new, required, vegetative screening. Mixture of Uses - The size of the site does not lend itself well to a second use, however, the proposed use will be located in a mixed use shopping center which includes apartments. Mixture of Housing Types and Affordability - Not Applicable. Redevelopment - The infill nature of this project serves to intensify use of the shopping center rather than relocation to a more visible portion of an Entrance Corridor. Site Planning that Respects Terrain - No critical slopes or flood plain will be disturbed with the construction of the proposed use. Clear Boundaries with the Rural Areas - This site is not located along a boundary with the Rural Area. Engineering Analysis: The County's Engineering staff has reviewed this request for engineering issues related to health, safety, and welfare requirements. The Engineering Department is recommending approval of both special use permits since most of their concerns can be addressed during the review of the final site plan. ARB Considerations: The ARB has reviewed both special use permits and the site plan for appropriateness. Although they expressed no objections to the use they are recommending a number of conditions (conditions #1-5 below) intended to minimize the visual effect on the Entrance Corridor. Similarly they have approved the site plan with conditions for additional landscaping and screening, (Attachment D). STAFF COMMENT: Section 31.2.4.1 of the Zoning Ordinance below requires that special use permits be assessed as follows: Will the use be of substantial detriment to adjacent property? Vehicle rental and maintenance at this location would not be of substantial detriment to neighboring properties given the minimal frequency of traffic that could occur for such a use. Two neighboring properties, Pantops Shopping Center and the Shell gas station, have comparatively higher amounts of traffic than this proposed use and this use should not have any negative affects on the aforesaid properties. The parcel containing the apartments, although abutting, is well to the south and behind the shopping center. The two uses are visually and physically separated and will not directly share vehicular access. Will the character of the zoning district change with this use? The use should not have any altering effect on the character of the district considering the predominant automotive service-oriented uses in the Pantops area. Will the use will be in harmony with the purpose and intent of the zoning ordinance? C-1 districts are intended to permit selected retail sales, service and public use establishments which are primarily oriented to central business concentrations. The proposed use as a vehicle rental and maintenance facility is consistent with the uses allowed in such concentration of services. Will the use be in harmony with the uses permitted by right in the district? By-right uses in C-1 districts tend to be retail and office in character. Those allowed under a special use permit are normally those which have the potential to generate more traffic or noise in the district. The proposed site is small and will be used as a U-Haul rental facility. It is not anticipated that this proposed use will generate more traffic or noise than would be in a typical retail establishment allowed by-right. Therefore, the proposed use is expected to be in harmony with uses that are allowed by-right. Will the use comply with the additional regulations provided in Section 5.0 of this ordinance? No regulations in Section 5.0 apply specifically to this site. Will the public health, safety and general welfare of the community be protected if the use is approved? The public health, safety, and general welfare of the community is protected through the special use permit process which assures that uses approved by special use permit are appropriate in the location requested. One of the concerns addressed in the review of this site has been the traffic flow into and around the site. Staff had initial concerns regarding the design of the ingress and egress of the site. Given the orientation of the entrance of the subject site to the curve in Newhouse Drive (a private road) and an alleyway serving the rear of Pantops Shopping Center, staff anticipated potential traffic conflicts. The initial design would have been confusing to drivers coming towards the site from Route 250. Without proper striping and signage, confused drivers may have entered the site mistakenly rather than continuing around the curve of Newhouse Drive into Pantops Shopping Center. Trucks exiting the site or the adjacent alleyway against such traffic could have been hazardous. Staff has worked with the applicant in solving this problem and the applicant has since added the appropriate striping and signage to the plan required for safe and convenient access to all the properties along Newhouse Drive. Since the site does not release traffic directly onto Route 250, customer traffic should have safe and immediate access without any problem. SUMMARY: Staff has identified the following factors, which are favorable to this request: 1. The ARB has expressed no objections to the use and has approved a Certificate of Appropriateness (Attachment D). 2. Facilitates infill development within the Development Area. 3. The site would use an existing internal road network, which would not further the increasing strip development along Route 250. Staff has identified the following factors, which are unfavorable to this request: 1. The Comprehensive Plan recommends that river oriented development be explored for the site's location. Replace the three trees in the central parking island with a species that is compatible with the other plants proposed on site. c. In the northeastern parking island, shift the Honey Locust slightly to the south to provide sufficient space for all plants. d. Continue the holly along the side of the building to the south corner. e. Substitute the white pine on the side of the building with an ornamental tree. f. In the biofilter: a) continue the Eastern Red Cedar past the Sweet Gum to the single Clethra; b) show the Inkberry and Clethra at mature growth; c) Cluster the Inkberry and Clethra in groups of 5s or 7s. 2. Provide standard water and sewer general plan notes on the cover sheet. 3. Provide plumbing fixture information for sizing the water meter. 4. Provide a note stating that a backflow prevention device is required on the domestic water service. 5. If approved, reference the SP numbers on the site plan and note all conditions of the SP's on the site plan. 6. An erosion control plan, narrative and computations. 7. The new ATM would be installed below an addition to the existing canopy, as a replacement to a walk-up machine that is currently located inside the building (Attachment A). In addition to the structural changes that this proposal will require to the canopy and for creation of a pad for the ATM unit, the applicant is also proposing to change the travelway to a one-way circulation pattern. If approval is granted for the requested special use permit and a modification to allow one-way circulation, the Site Review Committee can grant administrative approval of a minor site plan amendment that is currently under review. Petition: The applicant's request is for a special use permit to allow the installation of a drive-through, automated teller machine [Section 24.2.2.13 ] in association with an existing bank, which is allowed by right (Attachment B). The property, described as Tax Map 61 - Parcel 123F, contains 0.839 acre, zoned HC, Highway Commercial and EC, Entrance Corridor (Attachment C). This site is located in the Rio Magisterial District at the intersection of Rio Road West (State Route 631) and Seminole Trail (U.S. Route 29), and is recommended for Regional Service in Neighborhood 1. RECOMMENDATION Staff has reviewed this proposal for conformity with the Comprehensive Plan and compliance with Section 31.2.4.1 of the Zoning Ordinance, and recommends approval of the special use permit with conditions. Plannin~ and Zonin~ History SDP 81-044 The Rio/29 Center - The original site plan allowing the construction of the Guaranty Bank building was approved in September of 1981. The building was constructed in 1984 with the existing drive-through window in its current condition. Because this site plan pre- dates the adoption of Section 24.2.2.13 (the applicable regulations requiring special use permit approval to allow drive-through windows), the bank's existing canopy is considered to be a nonconforming structure. Although use of the non-conforming canopy as a drive-through structure has gone on continuously since construction of the bank, Section 6.3 of the Zoning Ordinance only allows administrative approval for alterations to nonconforming structures under certain circumstances. This includes routine repairs and maintenance, and repairs or reconstruction to correct unsafe conditions or damages that result from factors that are beyond the control of the owner of a nonconforming structure. Therefore, the alterations being proposed for the installation of a 24- hour ATM cannot be considered among the changes that would be customarily allowed through administrative review, and the applicant is required to submit a petition for a special use permit. SDP 96-085 Guaranty Savings & Loan Minor Amendment - An amended site plan was approved administratively on August 15, 1996 to allow the realignment of several parking spaces for the installation of a raised planter at the front of the building. Character of the Area: This parcel is located on the north side of Rio Road West (State Route 631), at the intersection with U.S. Route 29, north of Charlottesville and across from Albemarle Square Shopping Center. In addition to the exiting bank, which is located within the Rio/29 commercial center this site is developed with a mixture of retail and office uses. Staff has recognized at least two other banks that have active drive-through windows with ATM machines that are located within close proximity to this site, one is located in the Gardens Shopping Center and the other is on one of the outparcels at Fashion Square Mall. Comprehensive Plan: Requests for special use permits within the Development Areas are assessed for conformity with the recommendations that are set forth in the Land Use Plan. In addition to being a use that is allowed by right in the HC zoning district, banks are also recognized as one of the typical primary uses in areas with a Regional Service land use designation. Chapter 2 of the Comprehensive Plan, entitled Natural Resources and Cultural Assets sets the goals for preserving scenic resources that are recognized as being essential to the County's character, economic vitality and quality of life. The Entrance Corridor Overlay District is intended to further the County's efforts toward attaining the Comprehensive Plan objective for maintaining the visual integrity of all roadways. The Architectural Review Board (ARB) addresses potential adverse aesthetic impacts by applying various County standards for development within the Entrance Corridors. Because of its location within the Entrance Corridor, the ARB has reviewed the construction activity being proposed with this request for conformity with the County's adopted design guidelines, and recommends approval with conditions (Attachment D). STAFF COMMENT: Staff will address the issues of this request in two (2) sections: Section 24.2.2.13 - Drive-through windows associated with permitted uses; and, Section 4.12.6.1 - Safe and Convenient Access - One-way Circulation. 2 1. Staff will address each provision of Section 31.2.4.1 of the Zoning Ordinance. The Board of Supervisors hereby reserves unto itself the right to issue all special use permits permitted hereunder. Special use permits for uses as provided in this ordinance may be issued upon a finding by the Board of Supervisors that such use will not be of substantial detriment to adjacent property, Guaranty Bank has been at this site with its two existing drive-through lanes since 1984. The bank already has an existing ATM that requires users to park at the site and walk up for access. Therefore, staff does not believe that the proposed expansion of the drive-through canopy for the new ATM lane would impose any substantial detriment upon the adjacent properties. that the character of the district will not be changed thereby, This bank is located within an active commercial development and this request to allow the drive- through ATM is consistent with other banks that are located within the HC zoning district place and in the close proximity to this site. The Architectural Review Board has reviewed the proposed minor site plan amendment and the special use permit request to allow the ATM for its potential impact on the Entrance Corridor Overlay District, and recommends approval with conditions. Because ARB approval is also required for the architectural treatment of the canopy expansion, staff does not believe that any negative aesthetic impacts would result from the proposed development at this site. Therefore, staff finds that approval of this proposal would not result in change of character to the district. and that such use will be in harmony with the purpose and intent of this ordinance, Staff has reviewed this request for compliance with the purpose and intent of the Zoning Ordinance, as set forth in Section 1.4, and identifies no conflict that would arise as a result of its approval. with the uses permitted by right in the district, Although approval of this special use permit is required for the expansion of the nonconforming drive-through, this request represents a use that is accessory to a financial institution, which is allowed by right within the Highway Commercial zoning district. Therefore, it is staff' s opinion that the proposed drive-through is in harmony with the by-right commercial uses located within this district. with additional regulations provided in Section 5.0 of this ordinance, There are no additional regulations in Section 5.0 that specifically address banks that implement drive-through windows, automated teller machines and like facilities. and with the public health, safety and general welfare. 3 Due to concerns regarding access and circulation configurations, combined with the resultant high traffic volumes, new drive-through windows are only allowed by special use permit. Proposals to amend existing site plans are reviewed to ensure that the regulations for public health, safety and welfare are addressed adequately before any physical changes can be made on the site. Because there are two existing commercial entrances that allow adequate ingress and egress to this site, the Site Review Committee has identified no external safety concerns that would arise from the approval of this special use permit. However, during review of the originally submitted minor amendment, staff determined that the travel aisle widths could not accommodate a third drive-through lane for the ATM in the existing internal two-way travel configuration. Therefore, the applicant has followed staff' s recommendation to implement one-way circulation throughout the site and the removed the original southbound bypass lane that would have created conflicts between vehicles heading in opposite directions with the northbound drive-through lanes. Because of this, staff can identify no remaining concerns for public health, safety and welfare pertaining to this request. SUMMARY: Staff has identified the following factors, which are favorable to this request: The proposed changes to the by-pass lanes and travel direction would improve the site's internal traffic configuration. Approval of this special use permit would have the effect of bringing the bank's canopy structure and drive-through window into conformity with current zoning regulations. Because there is already an existing walk-up ATM machine at this site, staff does not anticipate a significant increase in traffic as a result of approving this request. The following factors are relevant to this consideration: The opportunity for 24-hour banking service provided by automated teller machines are often considered to be a standard function of banks and other financial institutions. The applicant's request indicates a belief that those services can be provided in a safer manner if ATM users are allowed to make transactions without leaving their cars. RECOMMENDED ACTION: Staff finds that this request generally complies with the provisions of the Zoning Ordinance and the Comprehensive Plan, and recommends approval of SP 02-026 with the following condition: The permittee shall continue to provide one-way circulation with an unobstructed bypass lane that allows the safe passage of vehicles that do not enter the drive- though lanes. The portion of the existing vertical wall element that extends above the canopy shall be eliminated. o Staff will address the request for a modification to allow a one-way circulation configuration with consideration for the provisions set forth in Section 4.2. The applicant is requesting permission to provide one-way circulation through an existing parking lot and in lanes that will bypass the drive-through windows and ATM (Attachment E). Section 4.12.6.5 of the Zoning Ordinance requires that a minimum aisle width of 24 feet be provided for two-way travel lanes that are adjacent to 9-foot by 18-foot parking stalls. Section 4.12.6.2 of the Zoning Ordinance states, "One-way circulation aisles shall not be permitted, except that the Commission may approve one-way circulation in such case where the same is necessitated by the peculiar character of the site..." The travel aisle that extends through this site tapers to 17 feet and 6 inches wide at its narrowest point, and in cases where one-way circulation is being requested, the Department of Engineering and Public Works has generally required the implementation of travel aisles that are a minimum of 14 feet in width. Engineering staff has reviewed this request and the revised site plan amendment, which shows the installation of appropriate "Do Not Enter" and "Wrong Way" signs and "One-way" pavement markings, and recommends approval of the requested modification (Attachment F). Staff finds additional support for this proposal because it would allow the elimination the possibility for head-on conflicts that existed with the originally proposed two-way circulation configuration. Therefore, staff recommends approval of the modification to allow one-way circulation with the following condition: Appropriate signage and pavement markings shall be provided in general accord with the improvements that are shown on the amended site plan, entitled Guaranty Bank ATM Lane Minor Site Plan Amendment, dated June 6, 2002. The Site Review Committee has reviewed the preliminary site plan showing the site layout for compliance with Section 32 of the Zoning Ordinance and can grant administrative approval of if the required special use permit is approved (Attachment B). Petition: The applicant's request is for a special use permit to allow outdoor storage and display in the Entrance Corridor Overlay District [Section 30.6.3.2], as an accessory use to the automobile dealership, which is allowed by right (motor vehicle sales). This site consists of a 1.7 acre portion of the parcel recognized as Tax Map 78 - Parcel 9, which contains approximately total 18.8 acres, zoned Highway Commercial (HC) and Entrance Corridor (EC). This property is located in the Rivanna Magisterial District on State Route 250 East (Richmond Road), approximately 1/3 mile east of the intersection with State Route 20 (Stoney Point Road). The Comprehensive Plan designates this property as Regional Service in Urban Neighborhood 3. Character of the Area: The subject parcel is the former site of a restaurant and all adjacent properties are developed with commercial uses. Free Bridge Auto Sales is located on the adjacent parcel to the east and several other automobile dealerships are located south and west of the site on nearby properties along Route 250. A motel is located immediately to the west of this site, on the same parcel that is subject to this request. RECOMMENDATION: Staff has reviewed this proposal for conformity with the Comprehensive Plan, compliance with Section 31.2.4.1 of the Zoning Ordinance, and with consideration for Architectural Review Board comments, and recommends approval of the special use permits with conditions. Planning and Zonin~ History: The existing building on this site was constructed more than forty years ago. There is no site plan on record for the site being proposed for this use. An existing motel is located on another portion of the parcel. SDP 00-032 Free Brid;~e Auto Sales - At it's meeting on August 16, 2000, the Board of Supervisors granted approval of a special use permit for the expansion of another outdoor storage and display area onto a 1.132 acre portion of this property, which was later combined with the adjacent property (Tax Map 7S-Parcel 57B). Comprehensive Plan: Requests for special use permits within the Developments Areas are assessed for conformity with the recommendations that are set forth in the Land Use Plan. Auto dealers are listed as one of the several types of primary uses identified for Regional Service Areas under Table 1 of the Land Use Plan, entitled Land Use Guidelines. Those guidelines also recommend the implementation of proper screening for uses implementing outdoor areas for storage and display of merchandise. Chapter 2 of the Comprehensive Plan, entitled Natural Resources and Cultural Assets sets the goals for preserving scenic resources that are recognized as being essential to the County's character, economic vitality and quality of life. The Entrance Corridor Overlay District is intended to further the County's efforts toward attaining the Comprehensive Plan objective for maintaining the visual integrity of all roadways. The Architectural Review Board (ARB) addresses potential adverse aesthetic impacts by applying the County's various standards for development within the Entrance Corridors. The ARB has reviewed the request and the proposed landscape plan for conformance with the County's adopted design guidelines, and recommends approval with conditions (Attachment D). STAFF COMMENT: 1. Staff will address each provision of Section 31.2.4.1 of the Zoning Ordinance. The Board of Supervisors hereby reserves unto itself the right to issue all special use permits permitted hereunder. Special use permits for uses as provided in this ordinance may be issued upon a finding by the Board of Supervisors that such use will not be of substantial detriment to adjacent property, Staff has identified no detriment to the adjacent properties that would result from the approval of this proposal to allow the outdoor storage and display of motor vehicles. that the character of the district will not be changed thereby, In addition to the automobile dealerships located on the adjacent parcel to the east, there are several others with outdoor storage and display areas located on the opposite side of Route 250, and within the immediate area surrounding this site. The Architectural Review Board has reviewed this request to allow the outdoor storage and display of vehicles for its potential impact on the Entrance Corridor Overlay District and recommended approval with conditions. Because ARB approval is required for the proposed outdoor display areas as well as the architectural treatment of the building addition, staff does not believe the district would sustain any negative aesthetic impacts as a result of the proposed development of this site. Therefore, staff finds that approval of this proposal would not result in change of character to the district. 2 and that such use will be in harmony with the purpose and intent of this ordinance, Staff has reviewed this proposal for compliance with the purpose and intent as set forth in Section 1.4 of the Zoning Ordinance and identified no conflict that would arise from the approval of the special use permit. According to Section 30.6 of the Zoning ordinance, the intent of the Entrance Corridor Overlay District is, in part, to ensure a quality of development that is compatible with the county's important scenic, architectural and cultural resources through the architectural control of development. The Architectural Review Board has applied the County's adopted guidelines for development within the Entrance Corridor to the review of this request to allow outdoor storage and display and recommended approval of the special use permit. with the uses permitted by right in the district, Although a on this site, right within special use permit is required for the proposed areas of outdoor storage and display this request is for an accessory use to motor vehicle sales, which is already allowed by the Highway Commercial (HC) zoning district. with additional regulations provided in Section 5.0 of this ordinance, Staff has recognized no additional regulations set forth in Section 5.0 that specifically address automobile sales or outdoor storage and display. and with the public health, safety and general welfare. The special use permit that has been requested is directly related to the potential for imposing adverse aesthetic impacts upon the Entrance Corridor. The Site Review Committee has reviewed the site plan for compliance with the relevant development review regulations that are set forth in order protect the public health, safety and general welfare. Therefore, it is staff' s opinion that a combination of proper site design and implementation of the recommended conditions along with the issuance of a Certificate of Appropriateness by the ARB could assist in ensuring that the proposed development does not conflict with this particular concern for special use permits. SUMMARY: Staff has identified the following factors, which are favorable to this request: Motor vehicle sales is a by-right use in the Highway Commercial District; and, The Architectural Review Board has reviewed the request to allow outdoor storage and display and recommends approval with conditions. DISCUSSION: Participation in the bond issue requires both the School Board and Board of Supervisors to pass a resolution authorizing application to VPSA. It is anticipated at this time that the School Board will pass the resolution at their meeting on August 22, 2002 and the Board of Supervisors on August 14, 2002. The purpose of this trip is to learn about creative planning and development ideas from other communities, which may be applicable to our community. Burlington is known to have tried a number of creative ideas, which our whole community could benefit from. We want to make this a community-learning trip and thus want to make sure that leaders from the City/County/University and the private sector experience this trip jointly as our destinies are tied together and as we are part of one large community. The City has arranged similar learning trips in previous years to Chattanooga, Tennessee and Athens, Georgia.
