Dear Mr. Ryang:
Staff has reviewed your initial submittal for the above - referenced application to amend special use
permits SP2006 -3 8 and SP2009 -001 for revisions to site layout, concept plan and conditions. We
have a few questions and comments which are listed below:
PlanninE
Comments on conformity with the Comprehensive Plan are provided to the Planning Commission
and Board of.Supervisors as part of the staff report. Initial comments on how your proposal
generally relates to the Comprehensive Plan are provided here:
The land use designation for this property is Urban Density Residential and Urban Mixed Use in
Urban Neighborhood 3- Pantops.
Urban Density Residential — Uses are intended for densities of 6.01— 34 residential units per acre
with support uses and some non - residential uses. Urban Density Residential areas accommodate all
dwelling types as well as institutional uses such as places of worship, public and private schools,
and early childhood education centers including day care centers and preschools. Urban Density
Residential areas accommodate small areas of non - residential land uses on the scale of
Neighborhood Service, to serve residential uses. This may include corner stores, less than 4,000
square feet; live /work units above office and /or retail; small office buildings less than 20,000 square
feet; and studios /cottage occupations.
Urban Mixed Use — Uses allowed in this designation include retail, commercial services, office,
and a mix of residential types with density of 6.01— 34 units /acre.
The proposed amendment of this existing school is similar in type and scale to the designated uses
and to other such established uses in the immediate area. The revised layout for this site is in many
ways similar to the existing school site. The applicant proposes revisions to address: parking,
travelway circulation,'outdoor play and learn areas, stormwater management concerns and special
use permit conditions.
Neighborhood Model: The following describes how the proposed development meets or does not
meet the principles of the Neighborhood Model:
Pedestrian Orientation — Will there be walking paths throughout the campus? Some walking
paths /sidewalks are shown but not throughout the site. For example, how will you go from the main
office to the amphitheater? This principle is not fully addressed.
Neighborhood Friendly Streets and Paths — A travelway is shown at the rear of the campus. Some
landscape is shown on the plan, but there is not a lot of detail regarding whether there will be street
trees or landscape in the parking areas. The travelways serve as access through the site and also to
various parking areas on the campus. Landscaping of the proposed site is not described on the plan.
This principle is partially addressed.
Interconnected Streets and Transportation Networks — This property is primarily accessible from
Rolkin Road and there is a proposed exit only access onto Route 250 west from the site. Transit
service is available in the nearby vicinity, (Social Security Office). This principle is addressed.
Parks and Open Space — The plan shows several outdoor fields and spaces for recreation. This
principle is addressed.
Neighborhood Centers —There are many neighborhood centers located in the nearby vicinity, such
as the Martha Jefferson Hospital. This principle is met.
Buildings and Spaces of Human Scale — Details and descriptions of the proposed buildings were
not provided with this special use permit request. There are some new buildings on the site,
currently under construction per an approved site plan that are one to two stories in height. The
existing main building is 21/2 stories in height and appears to be the tallest building on the campus.
Buildings in the nearby vicinity are generally not more than three stories in height. With the
topography of the site, the existing buildings along with those currently under construction appear
to be in keeping with the scale of surrounding buildings in the nearby vicinity. However, it is
unclear what the scale ofthe proposed buildings will be on this site. This principle is not addressed.
Relegated Parking — The parking shown on the plan is for the most part relegated behind buildings.
However, as you enter the site from Rolkin Road there is a parking area located to the south in
which a portion of the parking area may be visible from Route 250 and Rolkin Road. Due to the
layout of the site, the topography and the location of existing buildings it would be difficult to
relegate all of the parking on the site. This principle is addressed.
Mixture of Uses — This is not applicable.
Mixture of Housing Types and Affordability — This is not applicable.
Redevelopment —This is not applicable.
Site Planning That Respects Terrain — Managed slopes are located throughout portions of the site.
Managed slopes may be developed if Design Standards are adhered to. Minimal disturbance to the
terrain is suggested. The existing wooded area along the northern perimeter of the site should
remain as is, as it serves as a screen to the adjacent townhouse development.

Clear Boundaries with the Rural Areas —Not Applicable.
More detailed comments may be provided after more detailed plans are provided.
Planning
1. Do you plan to subdivide the two parcels into one?
2. Conditions shown on the plan will need to be the new proposed conditions.
3. It appears a layer needs to be turned off of the plan that was provided because in the parking
lot that is located northeast of the Arts and Gymnasium buildings there are two rectangle
shapes. What are these?
Zoning
The following comments related to zoning issues have been provided by Ron Higgins:
1. Actual parking proposed totals 67 spaces instead of 65. This is a reduction from the 72
spaces now on the combined sites. 67 spaces is deemed to be sufficient for the use.
Engineering and Water Resources l
The following comments related to engineering and water resources have been provided by Justin
Deel:
1. The proposed right turn only exit only onto US 250 cannot be reasonably enforced.
Generally, right turn only exits are only feasible where there is a median preventing left
turns. The existing median ends just beyond the proposed exit.
2. Stormwater management facilities (BMPs) must outfall into an adequate channel. Based on
surround topography, this does not seem easily feasible given the locations of the proposed
BMPs.
Architectural Review Board:
The following comments related to ARB issues have been provided by Margaret Maliszewski:
1. Some trees on the Existing Conditions plan that are located outside the area where new
construction would occur are deleted on the Master Plan. Please explain why.
VDOT
Comments provided by Troy Austin from VDOT are attached.
Fire/Rescue
The following comments related to Fire - Rescue issues have been provided by Robbie Gilmer:
1. All new proposed travel lanes shall be 20 ft unobstructed travel ways.
2. Radii shall be a minimum of 25 ft.
ASCA/RWSA
The following comments related to water utility issues have been provided by Alex Morrison of
ACSA:
1. During the permitting for the last building it was determined that a future waterline
extension would be required to provide 2 feeds to the site. This is required for fire flow
purposes. The ACSA would like the applicant to show a future water main extending from
the FHA located in front of the Arts & Gymnasium building, along the connector road to the
middle school, to the existing water main along the frontage of the middle school property.

This connection, unlike previous ones discussed, would loop the site without the need for
offsite easements through another development. Water utility plans will be required for the
new water main, as well as the reconfiguration of the drive aisles in front of the Arts &
Gymnasium building.
The following comments related to water and sewer issues have been provided by Victoria Fort of
RWSA:

SP Conditions
Revisions to the conditions relating specifically to the fencing around the old playground area are
currently under review with SP201400002. Additional information will be forthcoming regarding
SP conditions.
Action after Receipt of Comments
After you have read this letter, please take one of the actions identified on "Action After Receipt of
Comment Letter" which is attached.
Resubmittal
If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal.
The resubmittal date schedule is provided for your convenience.
Notification and Advertisement Fees
The Board of Supervisors amended the zoning ordinance to require that applicants pay for the
notification costs for public hearings. Prior to scheduling a public hearing with the Planning
Commission, payment of the following fees is needed: .
$157.85 Cost for newspaper advertisement
$200.00 Cost for notification of adjoining owners (minimum $200 + actual postage /$1 per owner
after 50 adjoining owners)
$357.85 Total amount due prior to Planning Commission public hearing
Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the
Board hearing needed.
$157.85 Additional amount due prior to Board of Supervisors public hearing
$515.70 Total amount for all notifications Fees may be paid in advance. Paymentfor both the
Planning Commission and Board of Supervisors public hearings may be paid at the same time.
Additional notification fees will not be required unless a deferral takes place and adjoining owners

Dear Ms. Grant:
We have reviewed the request to amend SP2006-38 and SP -2009 -001 and the amendment plan
dated February 17, 2015 as submitted by Waterstreet Studio and offer the following comments:
I . Route 250 at this location is a principal arterial. For the 35 mph to 45 mph speed limit
range, the minimum spacing between the proposed partial access connection to the
nearest commercial connection is 305 feet center to center. It appears that the exit only
entrance shown may meet this requirement, but the distance to the closest commercial
entrance should be.shown on the plan to determine whether an Access Management
spacing exception is required or not.
2. The existing connection to Route 250 is proposed to be modified to right -turn exiting
maneuvers only. However, detail to how this will be accomplished has not been
provided. Signage alone tends to. not be effective, so an entrance median/island should- be
considered.
3. Generally, VDOT does not have an objection to the proposed request provided that items
1 and 2 area addressed. These items may be addressed during the site plan review
process.

ACTION AFTER RECEIPT OF COMMENT LETTER
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set
(4) Withdraw your application
(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a
resubmittal date as published in the project review schedule. The full resubmittal schedule may
be found at www.albemarle.org in the "forms" section at the Community Development page.
Be sure to include the resubmittal form on the last page of your comment letter with your
submittal,
The application fee which you paid covers staff review of the initial submittal and one
resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee
Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request
an indefinite deferral. Please provide a written request and state your justification for
requesting the deferral, (Indefinite deferral means that you intend to resubmit /request a
public hearing be set with the Planning Commission after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
At this time, you may schedule a public hearing with the Planning Commission. However, we
do not advise that you go directly to public hearing if staff has identified issues in need of
resolution that can be addressed with a resubmittal.
After outstanding issues have been resolved and /or when you are ready to request a public
hearing, staff will set your public hearing date for the Planning Commission in accordance with

the Planning Commission's published schedule and as mutually agreed by you and the County..
The staff report and recommendation will be based on the latest information provided by you
with your initial submittal or resubmittal. Please remember that all resubmittals must be made
on or before a resubmittal date.
By no later than twenty -one (21) days before the Planning Commission's public hearing, a
newspaper advertisement fee and an adjoining owner notification fee must be paid. (See
attached Fee Schedule) Your comment letter will contain the actual fees you need to pay.
Payment for an additional newspaper advertisement is also required twenty -two (22) days prior
to the Board of Supervisors public hearing. These dates are provided on the attached Legal Ad
Payments for Public Hearings form.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The
only exception to this rule will-be extraordinary circumstances, such as a major change in the
project proposal by the applicant or more issues identified by staff that have not previously
been brought to the applicant's attention. As always, an applicant may request deferral at the
Planning Commission meeting.
(4) Withdraw Your Application
If at anytime you wish to withdraw your application, please provide your request in writing.
Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that
time, you will be given 10 days to do one of the following: a) request withdrawal of your
application, b) request deferral of your application to a specific Planning Commission date as
mutually agreed to with staff, or c) request indefinite deferral and state your justification for
requesting the deferral. If none of these choices is made within 10 days, staff will schedule
your application for a public hearing based on the information provided with your original
submittal or the latest submittal staff received on a resubmittal date.

Most applications for- Special Use Permits and Zoning Map Amendment require at least one public hearing by the Planning Commission
and one public hearing by the Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing
a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees for public notice
are required before a Zoning Map Amendment may be heard by the Board of Supervisors. The total fee for public notice will be
provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body.
