SUBJECT: SUB 2013 -00178 State Farm Blvd Sidewalk — Easement D (TMP 78 -64 & 65)
In response to your comments dated December 20, 2013, please refer to the following responses.
1. COMMENT. Proposed public easements should be labeled "dedicated to public use "or
otherm ise labeled as to whom the easement is granted A separate Deed of Easement may be
required; has this been coordinated with the County Attorney 's Office?
RESPONSE: Permanent easements have been labeled "dedicated to public use ". - however,
temporary easements are not to be "dedicated to public use ". The draft Deed of Easement, which
is being prepared by the County Attorney, is submitted herein for your review.
2. COMMENT. Revise the note regarding the watershed to indicate that this propert, is not located
within a water supply protection area.
RESPONSE: The watershed note has been revised.
3. COMMENT. Dimension the exterior boundary lines of the property.
RESPONSE: Exterior boundary lines that are shown have been dimensioned.
4. COMMENT. Provide the location and material of all permanent reference trrorrarrrrents.
Monuments found or installed prior to plat recordation may be referred to if they are permanent
and undisturbed. ff anv monument required by this chapter will be installed after recordation of
the, final plat. the certification of the professional engineer or land surveyor shall so note.
RESPONSE: All of the easements have been tied, with bearings and distances, to the closest
property corners and monumentation (where found) has been referenced. A boundary survey of
the entire property is usually not performed to prepare an easement plat. Corners will be set upon
completion of construction and a note stating such has been added.
5. COMMENT: Provide a definite bearing and distance tie between not less than two (2)
permanent monuments on the exterior boundary of the property and further tie to existing street
intersection where possible and reasonabhv convenient.

RESPONSE: The property boundary has been calculated and state plane coordinates have been
provided. A boundary survey is usually not performed to prepare an easement plat. Corners will
be set upon completion of construction and a note stating such has been added.
6. COMMENT. • This plat cannot be approved until ACSA completes their review: comments will be
forwarded upon receipt. Engineering has reviewed the plat and has no objection.
RESPONSE: As of this date, ACSA has reviewed and approved this plat.

Tom,
The County's R/W acquisition consultant would like for you to add the SF of acquisition, easement, etc. to each plat
given the small takes involved on both the above projects. We think this can be done by placing the actual SF below the
acreage in a smaller font in parenthesis. Do you have a recommendation on how best to handle per your experience?
Understand that the SF is going to be the basis of the compensation (though the Deed will reference acreage), which is
why this request is coming to you. Please advise.

I really appreciate you checking into the easement situation along State Farm. It is unfortunate that we don't have any
easements in that area, but I agree with Brian that we can't expect the County to obtain them as part of this project.

records. I would have liked to check myself. I have been trying, unsuccessfully, to obtain access to the County's online

Boulevard /South Pantops Drive, you are requesting that permanent ACSA easements be shown on

Please get with Tom and see what the records show. If these easement do not exist, then I don't believe that the
County should be required to obtain them. We are not moving any of their utilities beyond adjust elements to grade
except within their standards for meter placement and the hydrant easement already shown.

The fire hydrant easement plat looks good. You can proceed with preparation of the Deed of Easement.
The Deed of Easement will be prepared by an Albemarle County attorney, then reviewed by our attorney.

It sounds like I need to adjust the waterline easement. Do I need to shift the easement somewhat
(to ensure that the hydrant doesn't overhang the sidewalk), or just hold its present position and
increase it to 20'x20'?

The ACSA hydrant easement will need to be 10' to each side of a hydrant and 10' behind (from centerline of hydrant).
Also, please confirm that the hydrant does not overhang the sidewalk in its proposed location. It is difficult to tell on CR-
102 if this will be the case.

Please see the current design file for the State Farm Sidewalk project. You will see the fire hydrant easement on TMP 78-
67 that we need to develop a plat for the County. We might as well plat the temporary easement on this parcel, since we
are doing a plat.
I have not changed the r1w beyond that which you guys did a plat up near 250 last year. Please make this new plat and
submit me .PDF's of both plats for final review.

Attached are PDFs of the revised easement plats per Mr. Herrick's comments. In addition to the 5-
parcel plat, I also modified the plat for parcels 64 and 65 to reflect that the wall easement is a
permanent retaining wall easement so that the easement language will agree on both plats.

and 70, and a New Permanent [Retaining ?] Wall Easement Across Tax Map 78, Parcel 66, Located on State

Thanks for forwarding these proposed plats. I actually did have a couple questions:
1. While we have standard forms for temporary construction easements and permanent drainage easements, I'm
not sure we have a standard form for a permanent wall easement. What did you have in mind for those
easements? There is a Century Link splice box at this location. Since we are raising the grade around the box, a
small modular wall is needed to maintain access to the doors of the box (i re don't can't raise the box without
1llellrt'lllg a SI;p -il icant. cost so the decision ]s t.o build a wall). 1'he wall will be constructed willllll the, Casement (l.e.
not in the 1ZINA'). Can this simply be a "permanent access casement" instead of a "wall easement "?
2. Pages 7 -11 of the PDF are sheets 1 -5 of die same plat, or at least are numbered that way. However, each of
the five sheets has a different tide. Are they really four or five different plats, or just one? Our intent was for this
to be one plat, so the. owner would heed to sign only one document.. If one plat,, I assume they need to have tie
same title, correct? Do you have a preference?
Once we resolve these questions, I'll ask Erika to begin drafting die deeds of easement, one for each
separate set of plats: Correct
1. PDF 1 -2 - temporary construction easement from Upland, LLC and Sandollar, Ltd
2. PDF 3 -4 - permanent drainage easement and temporary construction easement from die
Virginia High School League, Inc.

corners. Usually we only set corners where there is a right
of way dedication or other alteration in property lines. You
can work this detail out with Tom if you haven't already.

Temporary Easements that is. These are granted as spelled out in the
deed. All permanent easements (water, sewer, drainage, etc) are

I guess I'm a bit confused about how all of these parcels "exist" with no existing monuments... but I'm not a surveyor
(obviously!), so perhaps this does make sense in the surveying world. The comment I made reads as follows:

It is our intent to not stake the easements and right -of -way until after construction is complete on both of these projects
(as would be done on a VDOT project). The reason being that any monumentation staked out by Tom's folks would be
disturbed during construction. Our construction contract will require the contractor to set the required VDOT right -of-
way monumentation once complete.

I'm still confused! (Sorry) If there is no existing property monumentation do we need to set a couple
of property corners so that there is an existing (ie, visible) corner? (Sometimes we have to re- create
boundaries based on record plats and property corners found on adjacent or distant properties.) I
guess what I'm asking is this: is it not sufficient to tie the easement to a missing property corner?
The property boundary has been calculated and state plane coordinates have been provided so the
easement isn't just "floating in space "; it has a definitive location.

shown on the easement plat? (A boundary survey of the entire property is usually not performed to
prepare an easement plat.)

I'm not totally sure about the temporary construction easement ... at the least, it seems there should be some sort of
deed that explains to whom the easement is granted and what is allowed, etc....but I basically made the comment as a
way to remind Frank (or whomever) to look into these issues. If Frank has discussed this with the County Attorney's
Office already, this may be a non - issue.
