Cabell Jones, Real Estate Paralegal Williams Mullen 200 South 10th Street, Suite 1600 Richmond, VA 23219 RE: LZC2015-00007 TMP 03200-00-00-019A2 P & R PROPERTY HOLDING LLC Dear Ms. Jones: In response to your request for a Letter of Zoning Compliance for the above referenced Property, please be advised of the following for TMP 03200-00-00-019A2; 1620 Quail Run, Charlottesville, VA Albemarle County (the "Property") The Property is zoned Light Industry (LI) under Chapter 18 of the Albemarle County Code (the "Zoning Ordinance"), lies within the boundaries of Albemarle County, Virginia (the "County"), and is located in the Airport Impact Area Overlay District (AIA). The LI zoning district permits the use of the property for warehouse purposes and offices; for the warehouse as a matter by right and independent offices up to 3000 square feet as a matter by right without the necessity of obtaining a conditional or special use permit. In the event of casualty or destruction to some or all of the improvements on the Property, the improvements could be rebuilt to their current specifications, subject to the approved site plan and the building code requirements. The Property is subject to Section 26 of the Zoning Ordinance and any applicable supplementary regulations in Section 5 of the Zoning Ordinance depending on the use. The Property is subject to Site Development Plan, SDP -1985-00047 approved on 12/30/1985. A site inspection was completed and revealed an inconsistency with the approved site plan. This inconsistency relates to the landscaping approved with the 1985 site plan. The shrubs along the 11 parking spaces at the south of the site no longer exist. It is the responsibility of the property owner to maintain the site as approved on the noted site plan. Changes to the site must be approved through the site plan amendment process. Removal of the landscaping is not a change that can be approved. County staff understands that landscaping dies and is sometimes not replaced. At this time no complaint regarding the missing landscaping has been received by this office. Thus, the County will not be pursuing a violation of the site plan at this time. The Property is subject to, the zoning requirement for a use or change of use of the property to first_ obtain a_Zoning Clearance before commencing operation. __ June 8, 2015 LZC2015-00007 Page 2 of 2 The current occupant of the building on the Property does not appear to have an approved Zoning Clearance, The improvements, save the landscaping mentioned above, thereof comply with the applicable requirements for the Zoning Ordinance and applicable rules and regulations of the LI zoning district, including, but not limited to, compliance with respect to the following: (i) setback of the building from the property lines. (ii) height of the building, (iii) parking requirements, and (iv) area width or depth of the land as a building site. The property is recognized as one separate parcel of land under the Chapter 14 of the Albemarle County Code (the "Subdivision Ordinance") and may be conveyed, leased, or mortgaged as one separate parcel and currently complies with the Subdivision Ordinance. The Property appears to gain access from the public road via an. access easement. No other conditions or special limitations were imposed by the County in connection with the subdivision approval. • There are no records of an open zoning violation filed on the Property. • Copies of the site plan may be obtained from this office with a request through the department's Records Manager, Esther Grace, at 434-296-5832 ext. 3823.
