Here's my take on this issue...This is a new(ish) problem on plats. "Public" appears to be a code name for"County or
VDOT responsible for". It is my understanding that the County Attorney's office and VDOT do not want"Public"
designation on easements any longer. It appears a development's HOA will be held responsible for the repair and
reconstruction of drainage structures should there be a need for repair or replacement, unless the OFD takes the
problem within an easement on as a "Public Works Issue". County and VDOT will check the pipe videos for proper
construction prior to bond release, but will not be held responsible for the maintenance and repair.
I'll talk to Chris about it to see what the County Attorney has said about this particular project.

I was wondering if you could do me a favor and let Chris Perez know if this should be a public easement. I guess he said
he sent the plat over to engineering to see if it should be private or public. To me taking all the road water it should be
public, but at this point I don't care. I tried to dropped off the bond this morning for the plat and mitigation plan, but
Ana is not in until 11 and she has no back up to take the bond,good times. Anyways would you mind looking at this and
get back to Chris because we are at the point of getting signatures on this thing.

Keith,
While the bonds have now been posted, we still need the County Attorney's office to sign off on the latest
version of the deed of dedication. Once I receive his approval, depending on if he approves it with conditions
or approved it outright with no conditions,then I'll need that document signed and notarized by the owner and
sent back to the County Attorney for his approval to form and then Tom Foley can sign it. Once Tom has signed
it then we have a plat that can be approved by the subdivision agent. Once it's approved then you can record it
along with the Deed of Dedication for the Drainage Easement and the Revised covenants and restrictions which
the County Attorney previously approved.
That's where we're at in the process. I'll keep you posted as to the status of the County Attorney's review of
this document.

B. $540,690 Subdivision/road performance bond - road
NOTE: Per Michael Vieira's e-mail dated 4/16/2015,the water and sewer bond that we are currently holding is more
than adequate to complete the Hyland Ridge on-site water and sewer infrastructure. No water and sewer bond is
needed for Hyland Ridge phase 2

Attached is a signed copy of Amendment#3 to the CC&R's to record the land Ridge Phase 2 Plat. It has all the
changes as set forth in Greg Kamptner's Review dated 4/27/15.
Also attached is a Red Line version of the Deed of Dedication and Easement. In light of the revisions to the Plat dated
4/29/15, I had a few more minor changes that were in addition to Greg Kamptner's comments dated 4/27/15. So,the

As discussed over the phone, to address this issue what I suggest is:
Plat Changes:
1) Throughout the plat label the applicable easements as either public or private
2)Also, I'd revise note#18 to state: "All public storm drain easements are hereby dedicated to public use."
Notably I believe there is only ONE public drainage easement which engineering signed off on as being public,
all others should be private.
Deed changes:
1) On the Deed of Dedication make the corrections Greg requested(Being the review cover letter from Greg is
not checked as "Conditionally approved and ready for circulation for signatures... " You can resubmit the doc
one of two ways: A. resubmit it unsigned and notarized for Greg to give it an conditional approval pending
signatures OR B. Make the changes and have the owners sign and notarize it pending Greg's review and then
ready for Tom Foley signatures.

Attached are the County Attorney's reviews of the legal documents.
* The Supplemental Declaration is conditionally approved pending the attached revisions.
* The Deed of Dedication for the Drainage Easement is not approved due to a required change within the

document. Also, Greg Kamptner has pointed out that note#18 on the plat is highly problematic and needs to be
revised. Planning staff understands that there is only one public drainage easement on the plat, all of the others
are to be private easements; however, this note as written makes all other easements public be they are not
stated otherwise. On the plat assure it is clear which drainage easements are public and which are private. Also,
assure that the owners of the private easements are known and that the maintenance of these easements in
covered in one of the legal documents. Please look over Greg's comments and make the appropriate changes, if
you have any specific questions please ask. If your legal council has questions for Greg please contact his office

1. All infrastructure must be built or bonded prior to plat approval.
2. Please show the 100 year water level limits, inlet and discharge in the swm area parcel, to ensure that the area
adequately covers the facility. This was not found.
3. Note 21 on the first page does not appear correct. No mitigation plan has been submitted nor approved for
buffer disturbance across lots 83 to 93, and there would be a limit of any disturbance within the first 50' (feet) of
the buffer. Either submit a mitigation plan for approval prior to final plat approval or correct the note #21 to
state "a mitigation plan is required for lots 83 to 93 prior to issuance of the building permit."

What we have recorded for Hyland Ridge,thus far, is attached. Ignore the page numbering on the bottom right of each
page,that is just because I pulled these copies out of a disclosure packet that I had handy. In summary the documents
include:
1. The original Declaration of CC&R's for Hyland Ridge,that the County reviewed, are recorded in Deed Book
4250, Page 68(on October 24,2012). The Plat for Phase I was recorded with this Declaration and all of the
public easements shown on the plat are dedicated effective with the recordation of the Plat. These CC&R's
dedicate all public right of ways and utilities to public use (Articles IV). When a later phases are made subject to
this Declaration of CC&R's then such later property is also subject to the language of this original Declaration.
2. On October 4,2013,we also recorded a Deed of Easement in favor of the County(Deed Book 4420, Page 576),
having to do with right of ingress and egress on the Hyland Ridge site for the purposes of Section 4 of the
SWM/BMP Agreement. I think the way we worded that,that it covers the whole site and we recorded the
Phase IIIA plat with the Deed of Easement.
3. Immediately thereafter,the 1st Supplement to the Declaration was recorded in Deed Book 4420, Page 587(on
October 4,2013). The substance of this Supplement#1 was to record and incorporate the Phase IIIA Plat for
Hyland Ridge into the full Declaration of CC&R's referenced in 1 above. Phase IIIA is subject to all the same
requirements as Phase I.
4. Supplement#2 to the Declaration was recorded in Deed Book 4489, Page 733(on May 15,2014). The
substance of this Supplement#2 was to record the Phase IIIB Plat. This recording incorporated the Phase IIIB
Plat for Hyland Ridge into the full Declaration of CC&R's referenced in 1 above. Phase IIIB is subject to all the
same requirements as Phases I and IIIA.
5. There are other utility and ACSA easements that I have not outlined here.
The second document attached is the draft Supplement#3 to the Declaration. This is how I intend to record the Phase II
Plat and subject the property therein to the full Declaration or Hyland Ridge.

1) With regards to the stream buffer,we will indicate a 10'-15' permanent drainage easement based on field
locating the drainage swale behind lots 83-93. This swale will direct runoff from the lots to the SWM facility.
