Dear Mr. Marshall:
The County Attorney and I have reviewed the title information for the above -noted property. It is
the County Attorney's advisory opinion and my official determination that Tax Map 91, Parcel
21 is comprised of three (3) parcels of record, two (2) with five (5) theoretical development
rights, and one (1) with one (1) theoretical development right, Tax Map 91, Parcel 21A is
comprised of two (2) parcels of record, each with five (5) theoretical development rights, Tax
Map 91, Parcel 31 is comprised of five (5) parcels of record; three (3) with five (5) theoretical
development rights, one (1) with two (2) theoretical development rights an one (1) with one (1)
theoretical development right, Tax Map 92, Parcel 64 is comprised of one (1) parcel of record
with five (5) theoretical development rights, Tax Map 92, Parcel 64A is comprised of twenty-
seven (27) parcels of record; one (1) with four (4) theoretical development rights, one (1) with
five (5) theoretical development rights, and twenty-five (25) small lots each with one (1)
theoretical development right, and Tax Map 9013, Parcel OA -11 is comprised of three (3)
parcels of record, one (1) with two (2) theoretical development rights, one (1) with one (1)
theoretical development right and one (1) with one (1) theoretical development right. The basis,
for this determination follows.
The Albemarle County Real Estate Assessment records indicate Tax Map 91 Parcel 21
contains 546.22 acres and eleven (11) dwellings, Tax Map 91 Parcel 21A contains 817.13
acres and one (1) dwelling, Tax Map 91 Parcel 31 contains 488.50 acres and one (1) dwelling,
Tax Map 92 Parcel 64 contains 378.91 acres and zero (0) dwellings, Tax Map 92 Parcel 64A
contains 672.72 acres and one (1) dwelling, and Tax Map 90B Parcel OA -11 contains 10 acres
and zero (0) dwellings. The properties are zoned RA, Rural Areas and are in the Lanark
Agricultural and Forestal District.
The most recent deed for Tax Map 91 Parcel 21, recorded prior to December 10, 1980, the
date of adoption of the Zoning Ordinance, is recorded in Deed Book 610, page 336 dated
November 29, 1976, the most recent deed for Tax Map 91 Parcel 21 A, recorded prior to
December 10, 1980, is recorded in Deed Book 636, page 261 dated September 9, 1977, the
most recent deed for Tax Map 91 Parcel 31, recorded prior to December 10, 1980, is recorded
in Deed Book 532, page 137 dated July 3, 1973, the most recent deed for Tax Map 92 Parcel
